Investigation And Research On Security Of The Land Rights Of Farmers In The Land Circulation For Collectivity-owned In Wuhu City

As farmers' essential security for production and living, not only materially source for survival and development, land is the important and ultimate social security. However, in the past 20-odd years, China's rapid economic and social development accelerated the pace of urbanization, which caused great demands of lands. In this process, a large number of collectivity-owned lands have been charged or expropriation, leading to a major concern for landless farmers' production and living. In order to explore solutions to the defects of existing land requisition system in protection of property rights and interests of farmers, as well as to meet the needs of survival and development for landless farmers, Wuhu City firstly implemented the reform in 1999 as a national pilot project, which was approved by the Ministry of Land and Resources.From the investigating on protection of interests of farmers during the usufruct circulation of collectivity-owned construction lands in Wuhu City, the promotion of intrinsic motivation to the improvement of the land requisition policies of the farmers and local governments, as well as the facts of reasonable uses and efficiency of land resources in the game of farmers and local governments ,we conclude: the raising awareness of collective rights enhance the dialogue between government and farmers, and local government pay more attention to the legitimate land rights of farmers through legitimate governing, making a certain effect on the usufruct circulation of collectivity-owned construction lands in Wuhu City. Also the innovation and success of the pilot is: cleared ownership of collectivity-owned land lays the foundation on protecting the rights and interests of farmers, the property rights of farmers has been fully embodied in the usufruct circulation of collectivity-owned construction lands during economic development.Through investigation and analysis, the papers finally summarize as follows: It is an important way to achieve the same treatment and land property rights of co-provincial farmers through the usufruct circulation of collectivity-owned construction lands, the ultimate choice to share the rapid economic development with the urbanization and industrialization. It is necessary for governments, enterprises and farmers to have consistent interest, role of the government should be redistribution, land circulation revenue management and supervision should be strengthened, the State Council and provincial government should implement further, including correspond law and sound policy environment.
