Analyze The Government’s Roles In Anti-dumping

At present, China has become the No. 1 target of anti-dumping investigations in the world, and frequently met anti-dumping complaints and measures in recent years.Starting from the anti-dumping theory, this paper analyzes the related theories, like market failures and the government’s responsibilities in anti-dumping. Chinese enterprises lack the awareness and ability of responding to anti-dumping investigations, their risk resistance capabilities are weak due to the comparatively single export structure, and anti-dumping investigations made by foreign countries are arbitrary because different countries have different standards of anti-dumping. All the above factors lead to the dilemma of frequent anti-dumping investigations against domestic enterprises. This paper believes that it has great significance for the government to play a greater role in anti-dumping lawsuits. As the maintainer of the national interest, the Chinese government plays multiple roles in answering anti-dumping lawsuits. Firstly, our government is the link for the enterprises to contact with foreigners. So compared with the enterprises, it is more convenient and faster for the government in collecting and delivering information. Secondly, the government has the natural advantage of integrating and allocating various kinds of resources because it is both a service provider and an administrator. Lastly, the government can provide abundant help and advice for the enterprises in anti-dumping lawsuits by perfecting the existing laws and policies or making new ones.Next, the paper adopts the method of case analysis, and studies how the foreign trade enterprises in Quanzhou dealt with anti-dumping investigations and also the function of the local government in these lawsuits. This paper tries to make an overall and deep analysis of the new characteristics and difficulties the foreign trade enterprises encounter in anti-dumping lawsuits, and elaborate the comparison between the role that the Quanzhou local government should play and the achievements it has reached. This paper believes that the government should play a more effective role in answering anti-dumping lawsuits, and promote the orderly development of our foreign trade. The government should guide the enterprises to exploit multiple markets and avoid the risks of anti-dumping investigations at the source, build a platform for the enterprises and trade associations to receive information about anti-dumping investigations timely, and strengthen talent training, establishing a high-quality talent team by providing policies and funds. The government should improve laws and policies, and take the initiative to mediate in the face of trade friction by providing service for the enterprises and protecting their interests, at the same time promote the sustainable and stable development of Chinese foreign trade.
