Along with the development of urbanization and industrialization, the land as a relatively scarce resources, in guiding the price mechanism of the market economy, the transformation of its use by agricultural land to non-agricultural land driving force more significantly, with the way the change of land use, the land around the value and the income distribution problem has become the focus of attention. Because of the scarcity of land resources led to the main body of market competing use of inevitable conflict of interests during the definition in recent years emerging incidents because farmers land property right is not clear, the land income distribution caused by uneven. Therefore, to solve the contradiction of land resources for the development of urban and rural areas, we must rely on the property to solve. Land development right as a fact of land property right, can make the property right mechanism in resource definition and vested interests when dividing function. Land development right is also a clear definition of policy tools, mainly caused by aiming at the dynamic changes of land property right the course of development and utilization and management of land in the property value or value-added benefits, to realize the control of urban and rural land use structure and proportion, to ensure the efficient and reasonable land use.This article in the summary of previous studies on the basis of land development right, by using the method of theoretical analysis and empirical analysis to the land development rights in land management practice in Chinese discussed. Property is an effective way to realize the efficiency, Research status at home and abroad summarized and compared firstly the land development right system, on the basis of summing up the foreign land development right operating system environment, legal environment, the transfer of property rights to the specific procedures and other content, implementation effect evaluation system of land development rights; at the same time, summarize the research on land development right of domestic achievement of theory and practice, and points out that the a necessary condition for the establishment of the system of land development right at home.Then, considering the idea of running mechanism of land development rights in practice, has selected three cases domestic representative: Chongqing ticket system, the South China Sea land joint-stock system, Guangzhou Wen-chong Village transformation as the case study. Select the three cases of the main reasons is considering the feasibility, the implementation of the system of the right to development by the rationality of land development and utilization, such as the right to development application effect, three case in the presence of a certain rationality and feasibility, as three different nature of the land policy, in the implementation process appeared on the right to development philosophy reference, provides strong persuasive application of it to the land development rights system in practice.Finally, aiming at the advantages and disadvantages of different institutional arrangements on behalf of the case analysis, and put forward the implementation mechanism and condition for the operation of land development right system, and on this basis, give the relevant policy recommendations, in order to solve the practical problems in the land utilization and management through the perspective of land development right.In this paper, with the help of the new institutional economics and property economics theory, the land development right is characterized as a divisible, a clear line of demarcation of land rights, under the premise of the right to development using our land management place in the implementation of theempirical analysis, and summarize the empirical research results, proposed the land development right in the local land management in the general pattern and further discuss issues.
