Study On Farmers’ Land Rights And Interests Under The View Of Three Rights Division

The issue of farmers is the key to the Three Rural Problem,the interests of farmers is the key to the issue of farmers,and the land problem is the key to the interests of farmers.Rural reform is an important part of the deepening reform.The reform of rural land system is the core of rural reform.The Comprehensive Implementation Plan of Deepening Rural Reform requires adherence to the principle of protecting farmers’ rights and interests.Taking the farmers’ interests protection as the starting entry point of deepening rural reform.Based on the question of the farmers’ land rights and interests protection,this paper constructs the theoretical analysis framework of ’rural land systemorganization support,implementation-farmers’ land interests protection’,and analyzes the present situation of farmers’ land rights and interests protection,the relationship between the property rights and the farmers’ land interests protection,the intermediary effect of the organizational support and the implementation.Based on the case of land ticket system and farmland circulation system,this paper analyzes the farmers’ land rights and interests in the transformation of land ownership,land use and land management right,discusses the intermediary role of the organization support and implementation.Finally,based on the practice of farmers’ land rights and interests protection system,we learn from the experience of foreign farmers’ land rights and interests,this paper puts forward the following five conclusions:1)The average score of the indicators of farmers’ land interests is between 2.7878 and 4.140(full of 5),that is,the situation of farmers’ land interests protection is generally,and there is room for further improvement.There are internal differences in the of farmers’land interests protection.Among them,the integrating and developing of farmers’ land interests is in good condition,the coordinating and sharing of farmers’ land interests,the representing and expressing of farmers’ land interests,the reducing and distributing of farmers’ land interests are in turn.The innovation of property right system has significant positive effect on the farmers’land interests protection.The organization support has some mediating effect on the farmers’ land interests protection,that is,the farmland property rights protection can directly promote the farmers’ land interests protection,but also indirectly promote the farmers’ land interests protection through organization support.Moreover,the role of grass-roots government,participation of rural organizations and the farmers’ ability have a partial intermediary effect.There is no mediating effect on the relationship between the implementation and the farmers’ land interests protection.There is no mediating effect on the relationship between the land dispute settlement and the farmers’ land interests protection.But the rural social security and rural financial services have intermediary effect.2)The land ticket system makes the rural collective economic organizations get rid of the ’shelling’ state,and strongers the basic economic,social and political functions of the rural collective economic organizations,promotes the farmers’ land rights and interests.To improve the land ticket system,it should innovation a green,open and sustainable land development concept,leave enough land development rights to the rural collective economic organization.It should improve the market-oriented land trading mechanism,establish a shared,modernization,coordination of land value-added benefit sharing mechanism.It should improve a legal,security of the land use system,establish a land transaction risk prevention and control mechanism system.3)The farmland circulation system promotes the scale management of land and the farmers’ land rights and interests protection.Specifically,the farmland circulation system reduces the intensity of agricultural labor,increases the income of farmers,promotes the transfer of agricultural labor,and promotes the upgrading and moderation of agricultural industry structure.Farmland circulation system has some problems,such as excessive competition in the agricultural land market,the lack of land transfer price mechanism and land transfer supervision agencies,the flow of land non-grain,low competitiveness of agricultural industry,non-sustainable agricultural industry.To solve these problems,this paper puts forward some suggestions on how to establish the land transfer price mechanism,standardize the farmland circulation market,innovate the land managemen,perfect the land circulation supervision and the agricultural industry service network,reduce the farmland circulation risk.4)The foreign land rights and interests protection system has important reference significance for the reform and innovation of rural land system in China.Bue it needs to be based on the collective ownership of rural land and the stage of economic and social development.In order to improve the level of land rights and interests protection,it is proposed to strengthen the property property rights of farmland property rights,give farmers more land property rights,regulate farmland circulation market,form marketed land transfer price,improve land acquisition compensation procedures,improve the land dispute judicial relief mechanism.5)Based on the empirical study on the land rights and interests protection,the case study of land ticket system and farmland circulation system,puts forward the reform of rural land system,cultivates the organization of land rights and interests,strengthens the implementation mechanism:To improve the reform of rural land system:innovates the implementation of the division of three rights,innovates the farmland market price formation mechanism,forms the community land development rights system,strengthens the multi-coordinated dispute resolution mechanism.To cultivate the organization of land rights and interests:strengthens the fundamental guarantee of farmer’s organization,defines the role of the village committee,exerts the basic protection of intermediary organizations,promotes the complementary role of rural communities.To strengthen the role of implementation mechanism:innovats diversification of government support for agriculture,improves the equalization of the rural social security system,improves the universal rural financial service system,strengthens the multi-coordinated land dispute resolution mechanism.Research on possible innovations is mainly reflected in the following three aspects:Firstly,chooses from the perspective of the division of three rights to explore the issue of farmers’ land rights and interests protection,to explore the relationship of property rights system of land rights and the land interests protection.Based on the land transactions(land ownership change,land use change,land management rights change),uses of specific examples to explore the farmers’ land rights and interests protection.And the land transaction is in line with the arrangement of property right system,the use of this research perspective has some innovation.Secondly,the paper constructs the theoretical analysis framework of ’farmland property rights protection-organization support,implementation-farmers’ land interests protection’,analyzes the status of farmers’ land rights and interests protection,the intermediary effect of the organization support and implementation.In addition,the paper takes land ticket system and the farmland circulation system as cases,analyzes the current situation of farmers’ land rights and interests,and discusses the intermediary role of the organization support and implementation of the farmers’ land interests protection.The research content has a certain degree of innovation,and has made valuable research conclusions.Thirdly,based on the empirical study on the farmers’ land rights and interests,the case study of land ticket system and farmland circulation system,it puts forward to perfect rural land system reform,cultivate the organization,and strengthens the implementation.It systematic suggests are innovative.
