The Study On The Shared Responsibility Mechanism Of Land Resources Law Enforcement Supervision

Since the reform and opening up, the land resources management in China has been improving gradually. However, with the development of socioeconomic status, some problems have emerged in land resources management. Land resources offences become more diversified, more complicated and more concealed because of rapid development of urban-rural integration and temptation of economic benefits. Law enforcement becomes difficult, which shows that illegal behavior is difficultly found, illegal evidence is difficultly investigated and ruling is difficultly executed. These difficulties are due to several factors, including the restriction of government institution, the lag between laws and reality, and the inadequate quality and ability of law enforcement personnel. Therefore, it is urgent to establish more stringent land resources management system in order to adapt to rapid development of social economy. The present study can strengthen the protection of cultivated land, enhance the management of land resources, keep land resources management in good order and promote economy and intensive utilization of land resources.In the present study, we explored relevant theories of share responsibility mechanism. The execution experiences of share responsibility mechanism in other places were used for reference to analyze the current status of land resources law enforcement. We discussed the theoretical basis and principle of liability fixation about share responsibility mechanism of land resources law enforcement. In addition, we further studied share responsibility mechanism of land resources law enforcement in two ways, the subject of liability and the dynamic mechanism.Finally, the paper put forward six aspects of countermeasure and suggestions, which include improving the relevant law and regulation share responsibility mechanism of land resources law enforcement, transforming local government behavior based on interest orientation, clear the responsibility of each subject,establishing severe administrative accountability system, improving quality and ability of the law enforcement personnel and establishing the new model of land resources law enforcement.
