Studies On The Effect Of The United States Patent Barriers On China’s Technology-intensive Products Export

With the further development of the knowledge economy and the globalization of trade,Intellectual property rights has become an important factors of production, Its effect on the economic and trade is more and more big.The competition for intellectual property rights in the international economic development is more and more fierce. At present, although China’s exports are still mainly labor-intensive products. But in recent years, China’s foreign trade structure optimize continually, technology-intensive products exports continue to increase, the technological content of the foreign trade products of our country is increase, the competitiveness in the international market is also growing,For the new situation of the export trade in our country, developed countries trade protectionism upgrade, they use new trade barriers to hinder the export trade in our country. And with the development of trade liberalization, the traditional trade barriers is limited, so the developed countries begin to use patent to build patent barriers which is in line with the international rules to safeguard their interests.The United States is the largest exporter of China,it is also the country where China companies encounter patent barriers frequently, the United States launched the "337 investigation",China become the main victim,the cases Which Involves China are increasing, it seriously influence the development of technology-intensive industry in China. So this article is given priority to the sino-us trade, summarizes and combs the patent barriers to technology-intensive products which encountered in sino-us trade exports, analyzes the influence of the patent barriers on China’s technology-intensive products exports,and then puts forward some corresponding countermeasures,to perfec intellectual property system and to deal with foreign patent barriers.to decrease the drag of going out with the development of technology-intensive industry in China, to obtain the advantage in international trade.This paper takes the patent barriers as research object,takes the relationship between the United States patent barriers and technology-intensive products exports as the main line, combines the domestic scholar’s related research, explores the influence of the patent barriers on China’s techno logy-intensive products exports from two aspects:theoretical and empirical. First it is introduction about theoretical basis of patent barriers.then it analyzes the situation of the patent barriers to China’s techno logy-intensive products. With the typical American’337 investigation" is given priority to, it mainly through the data and case analyse the situation of the technology-intensive enterprises in our country. Secondly, it analyzes the influence on China’s techno logy-intensive products exports, including long-term and short-term effects, and through the empirical analysis to explore the depth of the impact. Finally, it puts forward the corresponding solution measures, in order to improve the ability to cope with the international patent barriers in our country.After China’s accession to the WTO, the achievements of overseas expansion is great, the trade environment is also becoming quite serious. Technology vendors use patent strategy against our country enterprise in order to maintain profit, it has brought great losses to Chinese companies, so we need to develop effective measures to respond. In this paper, according to the part of the analysis and research, the causes of patent barriers existing problems of China itself, there are also foreign institutional and policy reasons. This article put forward the corresponding countermeasures and suggestions from three aspects:government, industry and enterprise. The Chinese government should strengthen the construction of domestic patent system, optimize the technical industry, national policy to support and strengthen dialogue and cooperation in the field of international patent. In addition, our country should also follow up related industries, among them, including accelerating the development of patent agency services and strengthen patent information service, and patent law. Finally, the technical enterprises in our country should strengthen the independent innovation, expand overseas patent layout, improve the protection of intellectual property rights consciousness, positive science dealing with patents.
