Food safety is not only closely related to every citizen’s health and safety, but also more related to the development of social economy and the stability of the market economy. Because food has the property of "empirical good", which uncertainty affects the understanding of its quality when consumers buy. In recent years, food safety incidents occur frequently. It damages the consumers’ legitimate rights and interests, which not only affect health, but also a threat to the country’s public security and the construction of a harmonious socialist society. In the certain extent, Food safety problem reflects on the existing in the regulation of our government. For these issues expose the imperfect laws, unequal information between consumers and businesses, and government agencies whose professional knowledge is limited, regulation efficiency is low, etc. At present, more researches focus on law of food safety issues, but to the administrative horizon, which combining the theory of government regulation theory analysis is less. Based on this, this paper related the theory of governmental regulation, by literature and comparative analysis, to study and analysis to the problem of food safety regulation in China. We analyze the status of China’s food safety regulation, food safety regulatory problems and their causes. By analyzing United States excellent practice of food safety regulation, we put forward the idea to solve the problem of food safety regulation in China. For our country, effective food safety regulation in the future can ensure the safety of food, the market economy healthy and orderly operation. The first part starts from the status of China’s food safety regulation, and analysis the current of food safety regulation subject, object and regulatory environment. Studying the basic content of China’s food safety regulation, and we further proposes several realistic problems of food safety regulation. The second part analyzes the reason why current China’s food safety regulation problem. Including the legal system and regulatory organizations, information channels.etc... The third part will expand the view to the practice of the food safety regulation in the United States. For legal system, this paper supports system and regulatory organizations, which tries to use the practice example. The fourth part summarizes the full text and put forward the specific path of China’s food safety regulation. With the release of a new "food safety", what is an opportunity to further improve the legal system of systemic, optimizing the regulatory organizations. We make an effort to improving the effectiveness of the government’s food safety regulation and the food production enterprises’ behavior. Ultimately, we achieve to improve food quality, raising the level of public health and insure safety for the purpose of life.
