Study On The Legal Mechanisms Of Economic Cooperation Between Guangdong, Hong Kong And Macau

With the expansion of economic cooperation between the Mainland, Hong Kong and Macao, Guangdong Province, with the advantage of geographical and language, carried out a series of economic and trade cooperation between Hong Kong and Macao. Related systems and policies were introduced. The author describes the contents and the problems of the legal mechanism of economic cooperation between Guangdong, Hong Kong and Macao, and put forward a number of recommendations to improve legal mechanisms for economic cooperation between Guangdong, Hong Kong and Macao. The author analysis the details of the legal environment for coordination and cooperation, and strengthen cooperation organization-building, establish specific dispute resolution. Each chapter is as follows:The first chapter: according to the concept of legal mechanisms of cooperation between Guangdong, Hong Kong and Macao, the author analysis the details of the legal nature, legal foundation and feature of the cooperation. Cooperation between Guangdong, Hong Kong and Macao is the further implementation of CEPA. The features that three areas belong to a country’s sovereignty gives greater advantage to facilitate cooperation between Guangdong, Hong Kong and Macao;The second chapter: it focuses on the main content of the existing legal mechanisms for cooperation between Guangdong policies proposed cooperation between Guangdong and legal mechanisms to solve three issues in the legislative, organizational management and dispute. Wherein one of the plight of the legislation is quite different in the three places of the legal system and social system, and the provisions of the existing organization and management principles and too simple that the dispute resolution only provides a consensus. All of these need to be studied to establish and improve the legal mechanisms of economic cooperation between Guangdong, Hong Kong and Macao;The third chapter: from the practice of regional economic cooperation overseas departure, the author studies on decision-making mechanism of the ASEAN and NAFTA dispute settlement mechanism. According to decision-making mechanism of ASEAN and complete NAFTA dispute resolution mechanism. The author put forward to the corresponding recommendations to improve cooperation mechanism between Guangdong, Hong Kong and Macao;The forth chapter: According to the extraterritorial legal mechanisms of regionaleconomic cooperation organizations and China’s national conditions, the author proposes the construction of the legal mechanisms for economic cooperation between Guangdong, Hong Kong and Macao. The first is to coordinate the legislative environment between the three areas, and secondly improve the functions of various aspects of the organization. Finally, in the dispute settlement mechanism, the author recommended that private actors as the main dispute body, and reference arbitration system to deal with the practice of disputes, and proposed drawing NAFTA’s "Y-X" principle to improve the dispute resolution.
