In recent years, food safety problems emerge in endlessly. Food safety problems not only bring economic losses to consumers, harm the confidence of consumers, but also have made huge impact to the development of food industry in China.A typical case such as melamine incident make Chinese buy milk powder overseas, leading some countries and regions to limit Chinese people buying milk. That not limited the development of domestic dairy industry but also tarnished China’s image. Food safety problems have brought huge challenges to our country government regulators, affect the government’s credibility. Strengthen legislation, institutional reform and other policy measures failed to solve food safety problems, then what measures we should take to ensure food safety and create a healthy consumption circumstance for the public.Enterprises are the food producers. This paper analyzes the present situation of the food industry, and found that the food industry itself is immaturity, there are uneven size, small enterprise are numerous, food supply chain is longer and structure is complex, there are information asymmetry in food chain. Because of the market defects, company will make opportunistic practice to pursue our there interests. In traditional government regulation mode, food safety regulation problem become more and more complex and the task become more and more difficulty. There are many problems behind the current food safety regulatory model, such as regulatory mechanism is imperfect, food safety standards system is not perfect, lack of technical resources, Grass-roots monitoring level lags behind, supervision heavy post-processing light to prevention. The power and responsibility is not clear between supervision department may prone to opportunism, and food safety has certain attributes of public goods may lead to free-riding, and food safety supervision have huge pressure but lack of practical incentive, these are the main reasons of food safety regulatory failure. Food safety regulatory system develops constantly, in order to ensure food safety, the national and the local government takes corresponding measures to regulate food safety. Based on recent interviews with several Shanghai law enforcement agencies concerned with food safety, this article aims to address a number of key research questions: what laws and regulations have been established and amended/improved in recent years in order to contain the frequent food safety crises? How do the relevant law enforcement agencies implement and enforce the laws and regulations? What kind of ‘governance modes’ have been adopted and are they effective? The outcome of this research indicates that the reactive mentality of law enforcement agencies in rigidly following rules and routine inspection methods has not been able to prevent food crises effectively. More holistic and proactive thinking and methods of implementation and enforcement of laws and regulations are needed, a heterarchic governance mode through interpersonal networking is necessary.Market failure and regulatory failure caused China’s food safety problems. From the point of view of food industry, Food safety problems have relation to production operators, managers supervise and other stakeholders’ issues. Enterprise are the first responsible of food safety. Social responsibility behavior and food safety has a close relationship.CSR behavior and food security is inextricably relations, corporate nature as a rational person is to maximize its benefits, how to encourage businesses to voluntarily fulfill their social responsibility is an important means to improve the environment of food safety, also is an important process to achieve co-regulation.CSR efficiency level can measure the effectiveness of corporate social responsibility behavior. Studying from the corporate social responsibility, it found that: there are large differences of the efficiency of enterprise social responsibility between food enterprises. The CSR efficiency level is at a lower level. The CSR efficiency in the increasing return of scale level, increase social responsibility investment levels can lead to a higher proportion of output; adjust the structure input of social responsibility in enterprises, can change the CSR efficiency and produce better business performance. Carrying out corporate responsibilities is primarily an act of their own, In addition to strengthening the sense of corporate social responsibility, a clear sense of social responsibility, but also need to be adjusted in the direction of fulfillment, Guiding from an economic perspective, but also very necessary. It can encourage enterprises to fulfill their social responsibility to obtain better results.China’s food safety problems related to the relationship between the interests of the plural subjects, food safety only relying on the conscious of enterprises and government regulation is difficult to guarantee. It is requiring plural subjects to jointly maintain it such as business, government, consumers, the third-party social forces. Facing the situation of structured market failure, it’s difficult to undertake social responsibility spontaneously and actively for the entire food industry. To ensure food safety, enterprises need pressure from outside to influence and restrict the behavior of Social responsibility. Starting from the food supply chain social responsibility build the food safety multi-interest co-regulation model. Elaborate the relationship between interests behavior and food security from internal and external food supply chain. Analysis on internal supply chain CSR suggests that dislocation of corporate social responsibility and profitability are present on the supply chain. The core business has advantage in social responsibility. The behavior of core business has an important influence on food safety. Starts from the perspective of costs and benefits,the Game Analysis between enterprises we found that corporate which pays the greater cost on social responsibility is not easy to obtain the corresponding income, then bad food market will occur Expels Fine phenomenon. Use the signaling model analyzing the relationship between corporate social responsibility signals and consumer behaviors to find the motivation factor affecting corporate social responsibility. Then guide enterprises to participate cohabitation from the perspective of the core CSR governance. To analyze external stakeholders participating in the supply chain from the response of a single subject of corporate social responsibility. Respectively studying the relationship between government regulation and food co-governance, between consumer and food co-governance, between third party and food co-governance, to define stakeholders role involved in the food co-governance and find the path to participate in co-governance.Study concluded that build a food safety co-regulation model which stakeholders work together need administrative guiding and the market regulation. Firstly, establishing food safety principles of social cohabitation and actively cultivating the food safety co-regulation entity. Secondly, adhering to the rule of law, improving laws and regulations, providing an institutional guarantee for food safety social cohabitation are advised. Thirdly, we need to enhance the capacity of the main stakeholders involved in co-regulation and create conditions for the participation of the main social cohabitation.
