Study On Vertical Administration Of Monitoring And Supervision Enforcement Of Sub-Provincial Environmental Protection Institution

Natural environment itself has certain carrying capacity and has been keeping a harmonious relationship with human beings for thousands of years, but with break of the carrying capacity of natural environment by human beings appears the problem of environmental contamination along with the rise of three industrial revolutions. Causes of environmental contamination problem in China at present are many and complex, of which, the root is the big deficiency in administrative system of China's environmental protection. In order to solve this institutional problem, the idea that the vertical administration of monitoring and supervision enforcement of sub-provincial environmental protection institution is put forward in the fifth plenary session of 18 th CPC Central Committee, but a new system usually goes through constant argument from its establishment to its performance, so does this new environmental protection administrative system. This thesis, starting from concept of the vertical administration of monitoring and supervision enforcement of sub-provincial environmental protection institution, analyses and demonstrates this new environmental protection administrative system to provide an easy reference to vertical administration of monitoring and supervision enforcement of sub-provincial environmental protection institution.The vertical administration of monitoring and supervision enforcement of sub-provincial environmental protection institution is a new environmental protection administrative system put forward when environmental pollution is serious and environmental contamination treatment is difficult. The government aims to bring our environmental treatment into a new developmental period by breaking through the bottleneck of our environmental control with the help of that system. The following are the necessities to perform vertical administration of monitoring and supervision enforcement of sub-provincial environmental protection institution: Firstly, it is the inner need of integration of environmental enforcement resources; secondly, it helps to overcome intervention from local government, promoting independence of monitoring and supervision enforcement of environmental institution; thirdly, it is the need of pressing environmental institution to legally fulfill its duties— the results of environmental treatment are not obvious largely because of sloth and mediocre administration and inadequate enforcement of environmental sector; fourthly, it is requirement of Tran regional environmental control—environmental control is asystematic project, and only by cooperation between kinds of government sectors can it get real fruit.Additionally, performance of vertical administration of monitoring and supervision enforcement of sub-provincial environmental protection institution involves not only legislative flaws of administration and relation between environmental jurisdiction of central government and that of local government, but also appointment and removal system of officers, staffing increase, source and security of necessary expenditure,centralization of environmental power and corruption of officers. These problems, if not solved, would make it much more difficult to perform vertical administration of monitoring and supervision enforcement of sub-provincial environmental protection institution. Author considers that constructing and perfecting legal system come first to solve them. Special fund for monitoring and supervision enforcement of sub-provincial environmental protection institution should be established, and central and local environmental protection responsibility system and personnel appointment and removal system should be amended and supplemented. Performance of this new environmental protection administration system requires proper allocation of staffing of environmental monitoring and supervision enforcement, and internal coordination mechanism between government sectors.
