Study On Conservation Easements For Watershed Ecological Environment

The existing law system of our country in the protection of the basin ecological environment is not perfect,which lacks the driving force and preventability. The conservation easement for watershed ecological environment has its unique value,which can overcome the above defects. It is a new way to achieve the purpose of protection of the ecological environment. The construction of the system contributes to the harmonious development of ecology, economy and society of the basin. The study of the system can also enrich our easement theory and ecological theory of property. This thesis has some practical value and theoretical value,which has important significance in the path selection of ecological environment protection law.This paper chooses the ecological environment of Minjiang basin as a microcosm of China's ecological environment of the river basin. It analyses the deficiency of the existing legal regulation of the basin ecological environment.However, through the exploration of the theory of the conservation easement for ecological environment, the inquiry in other countries' legislation,the study of the value of the conservation easement for watershed ecological environment,it founds that is reasonable to import the conservation easements for ecological environment. This paper concludes the types of the traditional easements in the fist place.Then,it analyzes the difference between the destruction of natural resources and the pollution of environmental.Finally,it fixes the types of the easements of conservation of natural resources unite with the ecological red line, and it fixes the types of the easements of environmental pollution prevention combine with adjacent relation's tolerance limit of public. Because the conservation easement for watershed ecological environment contains the public interest, it has special rules.This paper constructs the legal institution of the conservation easement for watershed ecological environment.And it discuses how to realize the application of the easement in the existing laws and regulations of the Minjiang River Basin,which tries to achieve the aim of law of protecting the ecological environment before the establishment of conservation easement system for watershed ecological environment.
