Wetlands,as "the kidney of the earth" are a fortune given to mankind by nature.For a long time,people's understanding of wetlands is relatively simple.With the development and utilization of wetland resources,and the popularization of relevant knowledge,protection of wetlands has become a human consensus.Though China's local wetland protection legislation is more active,the trend of natural wetland declining can not be effectively controlled.The paper covers four parts,the wetland overview,the current situation of China's wetland protection legislation,the United States and Australia wetland protection scope legislation research,China's wetland protection scope legislative suggestions.The first part is the wetland overview including the concept and value of wetlands.The second part is the current situation and issues of the protection scope of wetland in China,pointing out that the legal validity of the national regulation is low in national level,and local legislation scope is narrow,lacking special provisions.The third partt introduces the wetland legislation system and protection scope of the United States and Australia,takes the wetland legislation of New York and New South Wales as an example.In the fourth part,according to the above discussion,the paper puts forward the legislative proposal of wetland protection in view of the existing problems in our country.First,we should speed up the process of national law of wetland protection,and establish the scope of the division criteria.Second,clear the scope of protection of local wetlands,and expand the scope.What's more,coordinate legislation,strengthen the coordination between wetland special law and wetland factor resource law,national wetland legislation and local legislation,wetland legislation and wetland convention.And finally provides the various entities participate in the wetlands protection to implement the law.
