Theory Of Environmental Influence Assessment System In China

Environmental protection must seek a scientific and legal way,and environmental impact assessment is an important means of environmental protection and measures.Environmental impact assessment refers to the planning and construction,national laws and policies in the implementation,investigation,prediction,evaluation of environmental resources may influence human activities,can analyze the environmental consequences,and puts forward the countermeasures and measures of prevention and governance,and take the method of tracking and monitoring.The environmental impact assessment rises to the height of law and gives its legal binding force.The system aims to reduce environmental pollution caused by planning and project development,maintain human health and ecological balance.As an important legal system of environmental protection,environmental impact assessment system plays an important role in the field of environmental protection.The twenty-first meeting of the Standing Committee of People’s Republic of China in July 2,2016 Twelfth National People’s Congress on the "People’s Republic of China Environmental Impact Assessment Law" amendment shall come into force as of September 1,2016.However,the current system of environmental impact assessment in China and there are still many problems,but the existing system there are some problems in the implementation process,need to learn from foreign advanced experience in environmental impact assessment system,combined with China’s national conditions to further improve China’s current system of some environmental impact assessment.This paper elaborates from the following part of the environmental impact assessment system,firstly,discusses the concept and nature of environmental impact assessment system: the system of environmental impact assessment is the environmental impact of legal activities,through legal procedures to form the activities to be standardized,to make it enforceable.The nature of the environmental impact assessment has two sides,it is not only a part of the decision-making process,is an important means of constraints in the project construction,and give full play to the management of environmental protection departments carry out effective supervision and management.Secondly,the introduction of the United States,Canada,Russia,developed countries,environmental impact assessment system,summarizes the advanced experience,so as to inspire our country to strengthen the development of strategic environmental impact assessment,public participation and environmental impact assessment procedures.In this paper,the problems existing in the Chinese system of environmental impact assessment,including the environmental impact assessment for the object is not comprehensive,lack of alternative and public participation mechanism is not perfect,imperfect legal responsibilities,finally,evaluation of advanced countries in the legislative theory of specific operation system in reference to the environmental impact,combined with the practice of legislation China’s environmental impact assessment of the legal system of the thirty years and puts forward some legislative suggestions,mainly including the following six suggestions: the concept of ecological civilization and the basic principles of environmental impact assessment system;expand the scope of environmental assessment,improve the strategic environmental impact assessment system;introducing alternative system;improve the public participation in environmental impact assessment system.Including the expansion of scale,improve the organizational form and improve the information disclosure system;perfecting the environment.Sound evaluation system of regulatory system;improve the legal responsibility of environmental impact assessment system.
