Study On The Legal Problems Of Environmental Standards Title

In China environmental standards development accompanied by the environmental pollution,environmental standards,the main goal is to prevent environmental pollution to improve environmental quality.Based on the definition of the basic concepts of environmental standards and the nature of environmental standards,this paper found that China’s environmental standards the following problems: First,the core values are not prominent;Second,the development of environmental standards Norms;third,the development process is imperfect;Fourth,lack of content integrity.Combined with the third generation of environmental rights this paper proposed the following improvements:First,establish the core concept of the protection of human health,and as a starting point to establish a threshold system,through the concept of local and scientific development Secondly,to clarify the main body of environmental standards,to distinguish between the mandatory standard-setting subject and recommended environmental standard-setting subject,according to China’s "legislative law" proposed to give the district to set the city’s environmental standards,to promote China’s Environmental standards system refinement and improvement;Third,improve the environmental standards development procedures,the existing environmental standards to develop procedures to regulate the process that the environmental standards should be strictly in accordance with the procedures for the development of procedures,and in the form of ministerial order issued;Fourth,through the practice of combining current environmental standards,it is recommended to strengthen the environmental benchmark research in order to achieve the improvement of environmental standards.
