On Legal Issues About The Establishment Of Environmental Standard

In recent years,“the construction of ecology civilization” highlighted theenvironment problems. Accompany with the smog, water pollution and otherenvironmental problems, Chinese authorities and citizens began to pay attention toformulate a environmental standard.Environmental standard which is a concreteimplementation of national policy, provide the basic guarantee for the legislation,enforcement, judicature and observation of environmental law. The environmentalstandards can be divided into compulsory and not compulsory ones which differ intheir legal validity and status.It leads to many issues in formulation and enforcementof environmental standards.This paper has used literature research methods, empirical analysis method,comparative study methods and comprehensive multi disciplinary research methods.The author thinks that the environmental standards are in lack of core legal values,standardized subject of formulation all-sided contents, and scientific formulationprocedure. The reasons causing the above problems is that China has not legislatedthe environmental standards which prescribe rights and obligations.After comparative analysis between China and foreign countries, this essay alsoproposes the specific measures and suggestions on the perfection of formulation ofenvironmental standards, premised by the rise of laws on environmental standards,thus to enhance the legal force of non-compulsory environmental standards, reveal thecore legal value of environmental standards,clearily the position, standardize thesubjects of formulation, improve the formulation procedure and contents.
