Research On The Ethical Dimension In The Amendment Of Criminal Law (Nine)

A relationship between law and morality inextricably involved,and the maintenance of social order and consolidate and laws are not single handedly can do,but is the result of mutual coordination and adjustment between law and other social norms of action.The relationship between criminal law and moral problems of philosophy of law is an important proposition,but the relationship between law and morality is broad,the author is based on the criminal law amendment(nine)to explore the relationship between criminal law and ethics.The amendment of criminal law is a kind of way to amend the criminal law.It plays an important role in maintaining the stability of criminal law and promoting the development of criminal law and social development.Since 1997 China promulgated criminal law just introduced a single criminal law and criminal law are revised after the amendment to the criminal law in the form of visible China's legislature for the amendment of the criminal law's attention.With the increasing material and cultural needs and the ever-changing and complex social relationships,the relationship between criminal law and morality has also changed.The author discusses the ethical dimension of the amendment of criminal law(nine).In the first part of the article,the author introduces the background of the research,the domestic and international situation,the general ideas and main ideas of the thesis,and the main methods used in the research.The text explores from three aspects: first,the meaning of the amendment and the ethical research subject law,criminal law,criminal law definition,the law is a complex of experience,logic,ethics,and so is the criminal law.Second,the ethical implications of the criminal law amendment(nine).On the criminal law amendment(nine)in the process of revision,legislative democracy,fairness,justice and virtue ethics,criminal law and follow ethical principles including the emphasis on the authority of the law,respect for personal privacy and pay attention to the role of the good faith,this is also reflected in the criminal law amendment(nine)target as a guide to maintain social order and to protect people's rights and cherish life.Third,the ethical value of the criminal law amendment(nine).The amendment of criminal law(nine)has played its role in moral education,which embodies the combination of rule by law and rule of virtue,and finally provides a good legal environment for the free and all-round development of human beings.
