This report is based on the translation of the Judgment of the United States Court of Appeals for the Federal Circuit on Apple Inc.v.Samsung Electronics Co.,Ltd.,which the author had chosen as the source material for the MTI translation practice.The design patent infringement battle between Apple and Samsung has been raging for several years and at the beginning of 2016,the Supreme Court of the United States accepted the appeal by Samsung,which marked the first time since more than 120 years that it decided to hear a design patent case,and made the judgment itself valuable to be translated.For there has been no final judgment made by the Supreme Court yet,the judgment entered by the CAFC is chosen as the favored source material for the author's MTI translation project,with the purpose of combining the results of the research on legal translation with the legal translation practice and sharing the author's opinions about English-Chinese legal translation strategies.Guided by the principle of static equivalence,this thesis is going to analyze the translation of this judgment from the textual aspect,the syntactic aspect and the lexical aspect and offer applicable solutions.At the textual level,cohesion serves as an important function for all kinds of discourses especially highly formalized legal texts.And this function can be achieved by means of references,conjunction and substitution in legal translation.At the syntactic level,the following techniques including linear translation,division,voice change,amplification and omission are applied to translating long and complicated sentences.While at the lexical level,difficulties lie on translation of case citation and no equivalent words,thus the conversion of part of speech and textual translation are adopted to offer an acceptable translation.
