| With the development of China’s reform and opening up,improving the domestic business environment,especially the legal system environment and judicial services,has played a key role in attracting foreign investment and facilitating the global economy.The translation of Chinese judicial documents can promote foreign national’s understanding of China’s legal system and judicial system.This report is based on the translation of the civil judgment of Beijing Qingfeng Steamed Dumpling Shop Co.,Ltd,Vs.Shandong Qingfeng Catering Management Co.,Ltd.The translator adopted the legal equivalence theory proposed by Susan Sacevic and three principles of legal communication proposed by Prof.Du Jinbang to guide his translation.Based on Sacevic’s legal text typology,this report firstly analyzed the property of the judgment,that is,mainly descriptive but also prescriptive.Therefore,the translator analyzed the characteristics of civil judgments from lexical,syntax and textual levels,and applied legal equivalence in translation process to ensure the conveyance of legal concepts in different legal systems as faithful as possible,thus maintaining the prescriptiveness of judgment.At the same time,the translator also combined the three principles of legal communication to ensure the accuracy of the translation and deliver the descriptiveness part of the text.Before the translation process,the translator summarized the characteristics of Chinese judgments in terms of vocabulary,syntax and text and their differences from English and American judgments.Chapter five proposes solutions based on difficulties encountered at the lexical,syntactic and textual level.At the lexical level,it is the translation of legal terms,modal verbs and words with multiple meanings.Among the legal terms,according to the theory of legal equivalence,the translator focused on the three types of terms: near equivalence,partial equivalence and non-equivalence.Combining the three principles of legal communication and lexical expansion,legal equivalence was achieved in the target text.At the syntactic level,the translator analyzes the translation of long sentences,imperative sentences(court orders)and typical sentences of judgment.At the textual level,the translator analyzes the translation of the case citation in the Chinese judgment,focusing on its function of the retrieval and classification,and adopts literal translation.Through this translation practice,the translator has concluded with the principles,methods and techniques for the translation of Chinese judgments.Specifically,before translation,the translator should analyze the source text based on the legal text typology,and the translation should be guided by legal equivalence,combining the three principles of legal communication,and applying methods and techniques such as literal translation,conversion,and division,to solve specific translation problems. |
