| This thesis is a translation report of a judgment decided by the U.S.Supreme Court.Nowadays,Chinese government is embarking on a new journey to fully advance the law-based governance of China and moving swiftly to build a rule of law government.The legal communication among different nations is unprecedentedly crucial.America,as an advanced and developed country in the world,has set up a relatively complete legal system,which will undoubtedly provide valuable suggestions for China to build a rule of law government.Therefore,it is urgent and significant to translate foreign legal texts into Chinese.In this report,after analyzing the nature and characteristics of the source text,the author chooses text typology theory as the guidance and during the translation process,the legal equivalence principle and pragmatic principles are strictly observed.The author mainly adopts the pragmatic enrichment method and uses translation strategies such as literal translation,creative translation,transformation of parts of speech,addition,deletion and adaptation to achieve the legal equivalence in both linguistic function and legal effect.In the translation report,the author focuses on three aspects,that is,how to translate the case citation in a judgment;how to translate words and expressions in legal texts,which includes the translation of common words with uncommon meanings,terms of art,legal argots and formal and solemn expressions;how to translate long sentences,especially passive sentences without agents and emphatic sentences.When translating the terminologies and complex sentences,under the guidance of text typology theory,the author adopts different translation strategies to achieve the effect of legal equivalence.At the same time,the author also summarizes some techniques to solve the above-mentioned three problems. |
