The Influence Of Cases Involving The Missionary To Chinese Modern Legal System

In the late Qing dynasty,the advanced weapons and laws of the West had been spreading to China,then at the coercion of the West,the government of Qing dynasty signed a series of unequal treaties.Because these treaties gave a range of privileges to foreigners,including missionaries in China,so western religions which had been restricted had also developed.Unlike the late Ming Dynasty,during the late Qing Dynasty christian behavior of missionaries suffered boycott of the Chinese people and even the Chinese government,which resulting in the happening of many cases of including missionary,and the social was instability.When dealing with these cases,Chinese traditional legal culture often showed a great difference with the Western.After contrasting with the western legal culture,the drawbacks of the traditional Chinese law also were exposed,which is of great significance for the interpretation of traditional Chinese legal system and the construction of new Chinese legal system,then those defects are known to some people,they realized these differences,having the idea of reform which affected the modernization process of traditional Chinese legal system.But for the study of the cases of including missionary in late Qing dynasty,there is little attention to this,the author tries to make up for the defects.In order to explore the impact which cases of including missionary made on the traditional Chinese legal system,the author tries to analyze the case of Tianjin to show that the difference of Chinese and western legal culture is a cause that led the happening of cases of including missionary,and the influence of the modernization of Chinese legal system.
