| The Wei,Jin,southern and Northern Dynasties are known as the embryonic period of legal case stories.The legal case stories in this period show very different characteristics from those in the previous generation in terms of theme,plot structure,character image and layout.Previous studies mostly exist in the overall discussion of public case novels.Therefore,this paper based on the text of legal case stories in this period,carefully combs the source and content of the story,in order to show the unique face of legal case stories in this period.The paper is divided into five sections.The introduction mainly solves three problems.First,strictly define the research object and analyze the research status according to the relevant literature.This paper defines the concept of legal case story with reference to the views of Huang Yanbai and Meng Liye and Lv Xiao Peng.Second,it traces the development of the case stories and sorts out the characteristics of the fables of the pre-Qin princes and the descriptions of cases involved in the history of the Han Dynasties,so as to highlight the continuation and innovation of the stories of the cases in the previous dynasties.Third,clarify the research ideas of this paper and clarify the problems to be solved.The first chapter explores the reasons for the prevalence of legal case stories in the Wei,Jin,southern and Northern Dynasties and the source of the story.The social reality of frequent wars and disasters in this period made all kinds of public cases occur frequently in the society.During this period,the gradual improvement of the law,the development of novels and the fanaticism of religious superstition pervading the whole society provided convenient conditions for legal case events to enter the list of literary creation,and various legal case stories emerged.The sources of legal case stories in this period can be divided into inheritance and innovation.Inheritance stories mainly come from previous historical books and novel collections,which are added and deleted by editors according to different creative purposes;According to the content,innovative stories can be divided into three categories:inheritance,melting old innovation and independent innovation.The second chapter studies the classification of legal case stories.According to the content of the story,the legal case story is divided into two types:unrealistic and realistic.Non realistic legal case stories include ghosts and gods’ grievances,resurrection,animals’ gratitude and other plots.Although they reflect reality with illusion,the contents involved are diverse and the plot is tortuous,which constitutes the unique style of legal case stories in this period,shows the dark social reality and reflects the demands and psychology of all kinds of people involved.Realistic public case stories mainly present the basic forms and trial principles of legal case events in this period,reflecting the development form of early judicial trial from divine judgment to human judgment.Some of the stories show the concept of judicial trial and prison of officials at that time,mostly highlighting the images of characters.The third chapter discusses the culture reflected in the legal case story and the connotation of the times.First of all,the legal case stories in this period basically followed the Confucian legal tradition of entering the law with courtesy,but there are differences between them,which also showed the unique demands and wishes of the popular culture to conform to human feelings and conform to public opinion.Secondly,due to the needs of folk beliefs and traditional cultural ethics,the belief in ghosts and gods in the case story is also more prominent,which is specifically reflected in the type of Ming legal case.The third section of this chapter analyzes the connotation of the times presented by the case story.The official case story reveals the chaos of officialdom and reflects the people’s resistance spirit,that is,the longing for fairness and justice,and the attack and resistance to the feudal autocratic rule and feudal social order.From the contradictions and conflicts among intelligence,courtesy and law in the case stories of this period,we can see the presentation of social ethics at that time,that is,the praise of morality such as benevolence,righteousness,filial piety and integrity.Combined with relevant laws and regulations,compared with the judgment of legal case stories,it generally showed the trend of attaching importance to emotion at that time,such as the pardon of men and women’s private lifelong behavior,the trial principle of judgment of affection in judicial trials.The fourth chapter mainly explores the literary characteristics of case stories and their influence on later generations.On the basis of inheriting the conciseness and realism of historical biography,the language of case stories in the Wei,Jin and Southern and Northern Dynasties also absorbed oral language,made good use of dialogues with characters,and introduced poems into the stories,presenting the characteristics of conciseness,easy to understand and vivid and interesting.Its plot is also true and illusory,very tortuous,literary and readable.Through the study of the evolution of the private affair case MaiHuFenNv,this paper finds that this period has basically had a variety of public case types.The story model represented by the Ting structure and the iron nail case has had a certain impact on the novels and dramas of future generations,and some stories have motif significance.At the end of this paper,a summary of the legal case stories of the Wei,Jin,southern and Northern Dynasties is attached.The table provides a textual basis for interpreting the content and excavating the cultural and literary characteristics of the legal case stories. |
