The Analysis On Intellectual Property Protection Of Software User Interface In China

With the development of computer technology in our country, China’s software industry is becoming more and more mature. At present, the competitions of software companies in China have changed from purely functional competition to the competitions in the software user interface, the enterprises’ demands for the intellectual property protection of software user interface are ever growing. Now, China’s software enterprises have realized the importance of software user interface and invested considerable human and financial resources for the development of software user interface, and achieved very good results. However, because of the development costs of software user interface is high and its infringement cost is low, it is difficult to stop the infringement phenomenon of software user interface. The needs of intellectual property rights of software user interface are more and more. It has important theoretical and practical significance to study the protection of intellectual property rights of software user interface.Firstly, this article introduces the intellectual property protection demands of the software user interface in China and points out the important significance of the protection of intellectual property rights of software user interface. Then this article analysises the basic characteristics and essential attributes of software user interface and software user interface’s different attributes with works and patents, points out that the existing intellectual property system can not provide effective protection for software user interface. Next, combined with the situation of intellectual property protection of software user interfaces in China, the author introduces the protection of copyright and software user interface design protection mode of foreign countries, points out and analyses the existing software user interface protection problems in the process of software user interface intellectual property protection. At last, according to the actual situation in China, the author proposes that China should perfect the intellectual property protection system of software user interface as soon as possible and give users the rights of choose their own mode of protection of rights according to their own needs. At the same time, the author puts forward the conceptions and advices to further perfect the copyright protection, the invention patent protection and the design protection of the software user interface.
