Research On The Legal System Of The Safety Of American School Bus Operation And Inspiration Of China

In recent years, Chinese government introduces a series of administrative regulations and normative documents for school bus safety issues, but the legislation to ensure the safe operation of school bus has yet not been published. Although many local governments have issued relative normative documents about the management of school bus, but there still exists lag in legislation, unclear division of labor or responsibility and school bus safety standards about the school bus run system. The issues of frequent school bus accidents, severe overload, unqualified black school bus and other make the system run's improvement imminent about the existing school bus. In contrast, the United States, one of the most perfect school bus run all around the world, the federal legislation, has a relatively sound and a sound legal system ftom the state legislature to each school district school bus runs. In this paper, there are how the legal provisions of the school bus safety standards of the sort in the US school bus manufacturing process, discussing the role of the federal state, school districts, other social organizations in the school bus operation, the sources of the school bus run funding and operation mode, election system of the school bus driver and the training mode. By comparing the US school bus run system and combining with China's national conditions, it proposed that, firstly, China should improve the existing school bus-related laws to improve our school bus run system, regulate school bus safety standards, and provide views of legislative of protection to school bus operators regulatory responsibility, the school bus driver employment guidelines, and the school bus accident illegal accountability; secondly, governments at all levels should implement the funding of school bus, improve school bus service as the implementation of compulsory education's important part and provide appropriate financial support; at the same time, government should clarify the responsibility about all division in the school bus run, making public security, transportation, finance and other departments have effective supervision in their own law enforcement authority to the school bus safety operation. Besides, it should also establish a strict school bus driver screening criteria in the school bus drivers' physical fitness, driving skills and safety standard.
