Robert Nozick in his book Anarchy,State and Utopia.The state and the government cannot interfere with personal rights.He firmly defended individual right and proposed qualification theory which is different from Rawls' justice theory.Nozick's theory has also made great impact on western academia.He was as famous as Rawls.Nozick was on behalf of equality and Rawls stood for freedom.Based on individual rights,Nozick put forward minimum state theory.What's more,he thought the minimum state was the best country which can better hold personal freedom and protect individual rights.In the market economy,he firmly protected individual rights in case of the over expansion of government's rights would damage the individual rights.It is meaningful for China's society during the comprehensively deepen reform period.China will continually carry on the rule-of-law strategy,standardize government's rights and high value the individual rights as well as protect it after the 18 th CPC national congress,4th plenary session of18 th CPC Central Committee and 5th plenary session of 18 th CPC Central Committee.China can learn something from Nozick's minimum state theory in order to improve its modern management.We will build a high-efficient,clean and simple government,so we can realize China's great rejuvenation dream.This essay is made of three parts.The first part is to analyze the background of Nozick's state and individual rights' thought.The second part is to express theories of Nozick's minimum state and individual rights in detail as well as criticize Rawl's theory.The third part is the key point of this essay.It mainly estimates Nozick's theory of state and individual rights.We should build a better China based on the present national conditions and advantages of Nozick's theory.
