Research On Systemization On Real Right Of Carbon Emissions Right

As a new term coming with the global warming and other climate issues,"Carbon emissions" gradually goes into the public's vision with people's attention to environmental issues.The practical significance of carbon emissions has become increasingly prominent.But because the public law adjustment mechanism of environmental law and the blind spot of the environmental protection system of the Real Right Law the carbon emission rights in our country is not clear,there has not been a consensus on the nature of the decentralization of the carbon emissions in academic circles so far,and research on carbon emissions right system is limited,leading to a fact that carbon decentralization of ownership is not clearly defined.These will bring problems to carbon emissions trading practice.As for the nature of carbon emissions,in the use of development perspective,the carbon emissions as a right,there is the rationality and necessity of the law.Based on the private law,it is a rational choice for us to deal with the problem of climate by integrating environmental resources into the real right system.Although China has signed many conventions on carbon emissions in the international community,the domestic laws related to carbon emissions are rare,which use public laws to control the carbon emissions behavior.Carbon emissions' public property can't be denied,but concerned with tradable,negotiable features,private rights of property should be the real nature.Thus,the system design should be based on domestic "Property Law" to make declaratory provisions of carbon emission rights' real property.In the specific design of the system,combined with the characteristics of carbon emissions,this paper explains the manner and conditions to obtain carbon emission rights,eradication cases of carbon emission rights,rule of carbon emission changing,methods of publicity and protection of carbon emissions and so on.I hope to regulate carbon emissions with better institutional system and let laws protect the carbon emission trade.
