With the emergency of the "timetable" in the fully opening of government purchase of public services, the government purchase of public services will become a normal way of working of our government. Comprehensively promoting government purchase of public services is not only to play a decisive role of the market in resource allocation, but also put forward new requirements to the management capacity of the government, especially the government contracts management capacity. As a signing party of a contract and supervisor of contract enforcement, for the government, how to deal with this seemingly contradictory relationship between the longitudinal authority mode and the transverse negotiation mode is an important issue whether the contract management can be a success. Firstly, on the basis of sorting out the relevant documents, the article interprets the core content, the theoretical basis and necessity of the contract management capacity in government purchase of public services, and tries to analyses difficulties government encountered in the performance and its reasons in contracts management capacity of the purchase of public service from macro, meso and micro levels. The paper argues the reasons why contract management capacity in government purchase of public services face disadvantages are mainly in the following five areas:the development of market economy is not sufficient, transformation of government functions is not complete, the conflict of traditional bureaucratic culture and modern contract culture, contract management operation mechanism is not sound quality and the level of contract managers is unsuitability and so on. Then, the author try to learn many useful experiences of contract management capacity in government purchase of public services from America, England, Japan and Germany. We discuss the basic ways to improve the contract management capability in government purchase of public services:the first, improving the relevant legal system as the basis to create a good administrative ecology and legal environment; the second, developing the market economy as the foothold to the form a sound market economy system; the third, creating rational contract culture as a key point to focus on overcoming the constraints of traditional long-term ideological and cultural bureaucracy; the fourth, strengthening the government itself as the to center to use a variety of ways to enhance the ability of contract managers; the fifth, focusing on holistic development as the purpose to establish and improve the contract management system in government purchase of public services and so on.
