Cooperative finance is a special pattern which is different from commercial finance.In rural areas,establishing and developing the cooperative finance can be an important way to promote agriculture development and meet the capital needs of farmers.The first chapter of this paper is an introduction,in which the author introduces the research situation of rural cooperative finance.On this basis, the author point out the concept and some traits of rural cooperative finance.A well-worked cooperative finance system is a tool to solve the issues of agriculture,farmer,and rural area.The second chapter of this paper aims at sketching out the weak situation of Chinese rural cooperative finance and its reasons.In China,there is abundant research and experience of rural cooperative finance.However,there are still some problems in both organizations and legal institutions.By studying the shortcomings of Rural Credit Cooperatives and rural mutual cooperative,the author tries to point out the legal deficiencies.The third chapter studies regulations of rural cooperative finance in foreign countries including developed countries such as Germany,France,Japan and America as well as developing countries such as Bangladesh and India.The author summarizes some experience which is suit for China from these countries.In the fourth chapter,the author points out several problems of Chinese rural cooperative finance legal situation.For example the vague legal status,property disputes,and the lack of democratic management.Solutions of these problems is the key of establishing a healthy finance system.In the final chapter of this paper,the author gives some advice about a thorough rural cooperative finance legal system.Including publish an independent law,make clear its legal relationship,strengthen the risk management and so on.As a conclusion,the author put forward a more concrete idea of legislation.
