Research On The Third-Party Platform Responsibility Of Online Food Trade From The Perspective Of The Food Safety Law

The rapid development of the Internet to people's lives brought great convenience,online shopping food,online ordering has become Normal life.The greatest highlight of the new Food Safety Law lies in the fact that the online food trade related standardizing system enters the legal regulation for the first time.This paper elaborated the online trading food security related system being significant,the new Food Safety Law makes regulations to the online food trading third-party platform providers from several aspects like the food safety management responsibility,security control and legal liability.This paper focuses on the new Food Safety Law Article 62 and Article 131,about online trading food safety management responsibilities,and online trading food safety supervision issues,and third-party platform of online food trade rule system to discuss.In addition to the introduction and conclusion,the main structure of the paper is divided into five sections,a brief reads as follows:Part One introduces the general information about online food trade,so as to define the legal status of third party online food trade platform.Part Two elaborates on the issues existent among online food trades,the most notable of which are information asymmetry and regulatory difficulty.Part There interprets from a legal hermeneutics point of view the legal obligations of third party online food trade platforms on basis of Article 62 of the new Food Safety Law.Part Four discusses the safety management responsibilities of third party online food trade platforms,for example pre-trade inspection,during-trade regulation,post-trade rectification.Party Five analyzes,on basis of "public governance" spirits and civil law principles,the joint responsibilities that shall be borne by third party online food trade platforms when consumers' interests are infringed upon.This amendment undoubtedly promoted the development of internet e-commerce market,and acted as a bridge in the development of the online trading food security development.
