Legal Regulation On Consumer Rights Protection Of Online Ordering

As one of the forms of e-commerce,online catering has developed rapidly in recent years.Especially in the context of the COVID-19 epidemic,China’s online catering industry has developed rapidly.In the "two sessions" last month,the Investigation and Analysis Report on the Operation Status and Development Trend of China’s Catering Industry during the COVID-19 Epidemic in 2020 released by the China Cuisine Association showed that during the epidemic prevention and control period,the food consumption in the catering service hall decreased greatly,and some enterprises hoped that the delivery could increase their income.From everyone’s meals to household groceries,the takeaway brother can always deliver the goods needed by consumers to the door at the first time.Takeaway has gone deep into thousands of households,and consumers only need to move their fingers on their mobile phones to order the goods they need.According to reports,by the end of 2020,the number of consumers of online catering in China has reached 500 million.The arrival of the epidemic brought down many physical operators.During the epidemic,in order to cooperate with the national epidemic prevention and control work,physical catering operators had to close their physical facades.However,the prosperity and development of online catering brings great good news to the catering operators.By 2021,many operators have adopted a new mode of"take-away+take-out+light dining".Consumers eat at home,and takeaway brothers deliver food.The "New internet plus" model has created great benefits for our country’s catering industry.However,online catering is a business model in which the Internet will be the operator and consumer of both buyers and sellers,and it is highly virtual.The legal problems brought by this trading mode deserve people’s consideration.Exploring and studying the system of protecting online ordering consumers is a subject that we need to study deeply.By studying the development background of online catering and the research status of online catering at home and abroad,the author focuses on analyzing the current situation of national consumer protection.Secondly,by studying the specific behaviors of network operators and third-party platforms infringing consumers’ rights and interests,we realize the necessity of protecting the rights and interests of online ordering consumers in China.Thirdly,through studying the typical legal problems in the development of online catering in China,including the infringement of operators and platforms.This paper studies the foreign legal system and new policies on protecting online ordering consumers,and puts forward the contents that China needs to learn from.Finally,according to the national conditions of our country,this paper puts forward some concrete countermeasures to improve the legal system of China’s online catering industry and adjust the order of the online catering market.The author hopes that through the research of this paper,we can give some legal suggestions on protecting the rights and interests of consumers who order food online.
