Research About Food Security Risk Regulation And Legal Mechanism In China

Food is the first necessity of people and food issue has always been the important part of people's life.Recently,frequent food safety incidents have caused great damages to the health and safety of our citizens.Apart from that,they have also caused a series of bad influence,including reducing the people' well-being as well as bringing worries about the safety of food market among the public.Many citizens have negative comments on how the government deal the food safety,which effects the society's harmony and stability.The Chinese government has always attached great importance to food safety problems.In order to further solve the problem of food safety,our country has not only revised and implemented the new "food safety" law in 2015,but also reformed the regulatory structure of the food safety market.More efforts have been made to control the food safety problems from various angles such as legislation,law enforcement and judicial to comprehensive treatment.At present,we have achieved good social governance effect,and to a certain extent,have curbed the deteriorating trend of food safety market.But there are still many food safety incidents occurring from time to time,suggesting that the regulatory model in our country still has some deficiencies and defects.Therefore,we need to repair and improve.Food safety is a common dilemma that most countries are confronted with where they have all experienced the frequent period of food safety events.Nowadays the developed countries are making great efforts to gradually charge the supervision model from the old one which pays more attention to the afterwards relief work to the new one that attaches importance to the avoidance and regulation of the risk and precaution.Its purpose is to lower the frequency of the food safety events and the social consequences they bring in.Now,in terms of the supervision model in the current food safety market,it mainly adopts the security system of food safety which serves the traditional legal liability as the core,as well as the afterwards treatment at the cost of being affected.And it exerts much more influences on finding out who is to blame afterwards and the relief work.Although this traditional mode can make a strict restriction on the corresponding people in charge and make up pants of damage that the victim may lose,it still fails to solve the food safety problem fundamentally.Worse still the frequency of the related events concerning the food safety may be declined.Since our people hold the unbearable attitude towards the food safety any events that jeopardize the food security can be regarded as the severe distraction and challenge of harmonicons society construction.Therefore,in view of our country's current food safety overall situation and the special background of social transformation stage,it is not enough to pay attention to later accountability mechanisms and the improvement of the remedy mechanism,we also need to reduce food safety risks from the source and also the food safety incidents in the bud.Many current food safety incidents in our countries are evolved by the food safety risk,all these should have been solved from the beginning.So,from the perspective of risk regulation,it is of great significance in theory research about.how to reduce food safety risks,improve the related legal systems in our country,and thus keep a close eye on supervising our country's food safety market regulation scientifically,reasonably and efficiently.In order to analysis and expounds related problems in a better way,this thesis is mainly divided into four parts.The first part mainly focuses on the forthcoming and development of risk regulation theory,and its application in the food risk,which provides theoretical basis for our government in food safety regulatory functions and its responsibilities.The second part mainly lies in the analyze of the current food safety risk regulation,the study of its operation mode,the analyze of some existing problems in the meanwhile and therefore providing a more reasonable direction in how to improve the related mechanism research The third part we conclude the reference by combining the advanced experience and development of developed foreign countries,and through the analysis and review of the regulatory model.The fourth part is based on the lack of regulation mechanism for risk and law enforcement practice experience,I put forward the specific and reasonable suggestions.Starting from the basic theory,this paper analyzes the lack of regulation mechanism of food safety risks,by learning from the advanced experience of extraterritorial regulatory model,and combining with China's actual conditions and the legal practice experience,the paper systematically analyzes the problems in order to better solve the problems.It is expected thatthis paper can provide some academic significance and research value for solving China's food safety problems.
