The Television Mediation Under The Legal Perspective

After the reform and opening up, the establishment and the development of market economy and the accelerated urbanization process leaded to the transition of rural society in china. And the amount of the contradictions and the disputes presented growth spurt comparing to early stage of reform and opening up. How to resolve the rural family disputes effectively and establish a new mechanism accord with the characteristics of rural disputes has become an important task in the construction of dispute settlement mechanism. As a kind of new dispute settlement mechanism, television mediation provided a new path to solve dispute in daily life, especially the revision of The People's Mediation Law in 2010, which not only established the law status of the television mediation mechanism, but also provided the legal support for the development of this mechanism. As an agricultural province which agricultural population accounted for nearly seventy percent of the population in, Henan province explored the solutions of the rural family dispute actively, and took the lead in hosting the nationwide television mediation show--The Mediation of the People. In order to make The Mediation of the People play a positive role better in the resolution of the rural dispute, we carried on the empirical research about The Mediation of the People and hoped to promote the development of the mechanism of the television mediation, and made this kind of mediation pattern play its role better.The first chapter made a summary about the practice operation of The Mediation of the People. The first part expounded the definition, evolution and positioning of the television mediation. The second part combined with the instances of The Mediation of the People to describe the operation pattern of the television mediation. The third part summarized the reason why The Mediation of the People was so popular, and provided practical and theoretical support for the further expansion of the below television dispute resolution mechanism.The second chapter mainly analyzed the main problems of The Mediation of the People as a way of people's mediation. Although The Mediation of the People flourished, some problems appeared, which mainly reflected in the insufficient protection of privacy on the parties, the imprecise security of the execution of settlement agreement and so on. Developing a good TV programs needed to try the best to find the problems in the development of this TV programs. Only finding out the root can prescribe medicine.As to the problems found in the second chapter, the third chapter put forward some ideas, and hoped to promote the standardization of the television mediation mechanism. Mediation had a long history in China, and the development of television technology put the mediation on the screen. The audiences got the different experience on account of the public dispute resolution. The television mediation started relatively late, and it was still in primary stage, so it was hard to avoid some problems. Therefore, we needed to seek for the best method, improve the corresponding system, strengthen the self-construction of the television mediation mechanism, perfect supporting system, and promote sustained and healthy development of the television mediation mechanism. The author considered that we could take the following ways: Firstly, establish effective mediation mechanism, and guarantee the due process; Secondly, implement the specialization and the professionalization of the mediators. Thirdly, perfect the docking mechanism between the television mediation and the judicial, and expand the scope of dispute resolution; Fourthly, formulate specific rules of the privacy protection in the television mediation.
