Research On The Concept Of Mixed Government

As an important part of traditional western political and legal thoughts, the theory of traditional Mixed Government deemed that the most excellent regime model should be a mixed government which is a combination of the monarchy, aristocracy and democracy, not only playing an important role in the decision-making of the policy, but also to preventing the power decay. The most classic embodiment of the ancient mixed government is in the Roman empire. The idea in the west is considered as decentralization and balance. But the separation of mixed mode regime is not the only form of the concept of mixed regime; it can be embodied in the UK, France, etc, which reflects the characteristics of diversified government. With the change of social environment, western liberal democracy system inherent rigidity and internal friction characteristics are increasingly highlight. Francis Fukuyama recently proposed a theory called "three factors of the good social governance". It’s a kind of reconstruction to the excellent regime as well as the restoration and development to the traditional mixed government. As we can see, besides decentralization and balance, mixed government also confirmed the importance of resource integration and order execution to an effective governance, which is a symbol of the development of political civilization.As a kind of ideological elements, Mixed government philosophy is also reflected in the history of China. It is not only belongs to western political civilization but also can be applied to the structure optimization of Chinese political system. Actually,China has initially formed the "three prismatic" mixed regime pattern which centered on ruling power and balanced legislative, judicial, administrative at the same time. It makes a reasonable regulation for the ruling party leadership as the core of administration by law, and rationally builds the system from four dimensions of party leaders legislation, law enforcement, judicial support and law observation, which can contribute to the achievement of an excellent government structure with three-element coexist of state capacity, rule of law and democratic accountability. In a word, the mixed government is good for the world political civilization’s diversity.
