Research On The Legalization Of Accountability Of Party And Government Cadres

In recent years,no matter central and local governments at all levels pay more and more attention to the role of accountability,accountability has been gradually applied to every field of social public administration.From "SARS" events to "melamine",from "the Qi Lian mountain ecological destruction" to the " problematic vaccine ".A batch of party and governmental cadres have been punished because of "accountability",or even sentenced to prison.These things highlight the central party committee's firm courage and determination to uphold the rule of law and build a country based on the rule of law.The accountability of party and government departments in China started from the "SARS" in2003.In the development of more than 10 years,it has been presented a general rule :power accountability ——system accountability——legal accountability,in fact,that is the process of party and government cadres' accountability from scratch to optimization development.Under the general background of comprehensive rule of law,the accountability of party and government cadres is an important form of public governance and legal supervision,legalization is the only way.The construction of the rule of law for the accountability of party and government cadres is of great practical significance in promoting the construction of national rule of law,promoting social and economic development,improving the supervision and restriction of leading cadres and fully ensuring that people are masters of the country.At present,the construction of party and government cadres accountability under the rule of law in our country has obtained certain result,but,due to the late start,weak foundation,and the relevant legal system is not perfect enough,etc.Therefore,accountability under the rule of law are still in a primary stage,the accountability system of laws and regulations is not sound,the accountability mechanism is not sound,variant accountability system is not perfect all sorts of problems,such as the existence of short board,to a certain extent hindered the process of our party and government cadres accountability under the rule of law.In view of the current problems in the legalization of party and government cadres' accountability,this paper makes an in-depth analysis and search for the reasons,and then puts forward the countermeasures to solve the problems,so as to provide useful reference for promoting and improving the legalization of party and government cadres'accountability in China.This paper intends to elaborate the relevant content of the legalization of party and government cadres'accountability in China.The text is divided into four parts:The first part is the legalization of party and government cadres' accountability and its theoretical basis.This chapter mainly demonstrates the concepts of "accountability" and "accountability system",analyzes the elements of accountability system,and then studies the concept of "legalization of party and government cadres' accountability".And this paper from the views of Marx and Engels accountability and xi since the eighteenth big accountability in several aspects,such as the thought to the Marxism theories of party and government cadres accountability under the rule of law to describe in detail.The second part is the actual results of the legalization of the accountability of party and government cadres.This chapter elaborates the achievements of the legalization of the accountability of party and government cadres from two aspects of legislative construction and practical exploration.It mainly sorts out normative documents such as inner-party accountability laws and regulations,administrative laws and regulations,and local accountability laws and regulations,and analyzes the practical achievements of legalization of party and government cadres' accountability by combining typical cases.The third part is the problems faced by the legalization of the accountability of party and government cadres.This chapter focuses on the difficulties in the development of the legalization of the accountability of party and government cadres in three aspects: the incomplete legal and regulatory system of accountability,the incomplete supporting mechanism of accountability,and the imperfect accountability system.The fourth part is the optimization path of the legalization of the accountability of party and government cadres.In combination with the existing problems of the legalization of the accountability of party and government cadres,this chapter puts forward three solutions: improving the accountability system of laws and regulations,improving the supporting system of the accountability system of party and government cadres,andimproving the alien accountability system.
