The Application Of The Persuasion In Public Security Mediation

Nowadays,China is on its way to legal construction and many disputes need to be resolved.There are several ways of dispute resolution which can be mainly classified into lawsuit and non-lawsuit.Litigation is not the only way of dispute resolution especially in the society of China where the people are accoctomed to mediation instead of litigation when facing conflicts.Public security mediation which belongs to administrative mediation is a kind of mediations frequently appearing in people's usual life,compared to other ways of mediations.Its low cost and easy implementation make the judicial resource dramatically saved.It depends on the comprehensive qualites of the police to make the parties come to compromise so that the social function of the public security mediation can work.The key point helping to bring about an agreement between the two parties is the skill of the persuasion of the police rather than the grasp of the relevant laws.A good persuader is a man who could take the overall situation,analyze carefully and balance the benefit of the two parties.Because of the low level of the tremendous grass-roots police who have difficulty in persuading the parties with the simple skill of persuansion, sharpens the contradictions of the parties especially in the situation where the police is suspicious of bias for one part.As to the mentioned fact,this paper discusses how to enhance the skill of the persuasion for the police in the situation of the public security mediations from the standpoint of the persuasion theory for the sake of the harmonious society and governmental administration.Both ancient and modern times,there are several kinds of persuasion theories.This paper mainly states the west theories of persuasion of the scholars such as Socrates,Aristotle and Ciceron combining with ancient China's persuasion skills of Guigumaster and modern persuasion theories so as to boost the practical skills of persuading parties for the police in the situation of public security mediations by summarizing the common points of view of the west and east persuasion theories.In the discussion of the west theories of persuasion,I put Aristotle's rhetoric as the basic theory.His Ethos,Pathos and Logos as the three skills of persuasion are always the central idea of the paper. For Guigumaster,I mainly introduce his Maneuvers idea as the central idea in the area of ancient China's persuasion theories.At last this paper will analyze an true public security mediation case with theories mentioned to find some suggested ways to enhance the skills of persuasion for the grass-roots police in China.
