Deduction And Interpretation Of The Mediation System Of Grassroots Public Security Organs

At present,in some areas,there has been a new situation in which public security mediation has been replaced by people's mediation.However,the academic community has not responded effectively.This paper takes the Shenzhen A police station as an example to try to make a systematic study of this new situation.First of all,this paper focuses on the characteristics of public security mediation and people's mediation.Secondly,this paper explores the public security mediation by the people of Shenzhen A police station to resolve the real dilemma and the historical evolution and actual operation of the Shenzhen A police station mediation system.The reason for the mediation of substitution;again,this paper analyzes the advantages and disadvantages of the mediation of Shenzhen A police station after being replaced by the people's mediation,pointing out the problems existing in the mediation of public security mediation;and finally,improving the legality of the mediation system The three aspects of strengthening the effectiveness of the mediation system and improving the professionalism of mediators have put forward perfect suggestions.Specifically,the article is divided into five parts:The first part explains the related concepts,applicable conditions and principles can refer to the reasons of laws,regulations and rules,and focuses on the characteristics of public security mediation and people's mediation.This part believes that public security mediation has the characteristics of security,authority,etc.,and people's mediation has the characteristics of equality,high degree of desirability and convenience;The second part combines the specific situation of the Shenzhen A police station,and analyzes the contradiction between the shortage of police force and the heavy workload of the work of the Shenzhen A dispatched station,the contradiction of lack of ability and diversification of disputes,the imperfect system and the effective resolution of disputes.contradiction;The third part introduces the historical evolution and actual operation of the mediation system of Shenzhen A police station by dividing it into two stages: no mediation to mediation,public security mediation,and people's mediation;The fourth part mainly explains the advantages and disadvantages of public security mediation after being replaced by the people's mediation.Its advantages include expanding the scope of mediation,giving effect to the contract validity contract,promoting theimplementation of mediation agreement,and releasing the grassroots police force.The disadvantages include people's mediation and alternative law and order.Mediation is the two parts of the "hidden worry" in which the law is unfounded and the people's mediation is abused;The fifth part mainly demonstrates how to improve the mediation system of grassroots public security organs.This paper believes that it is necessary to solve the problem of no clear legal basis for the mediation of public security mediation in the mediation of the people,and encourage the qualified regions to formulate the implementation rules of the people's mediation to replace the public security mediation.The standard operation of the people's mediation;secondly,it is necessary to integrate the governance resources of all parties,strengthen the linkage between departments,and promote the effective resolution of social disputes to enhance the practical effect of mediation;finally,the article enhances the mediators through assessment,selection,training,etc.Professionally improve the mediation system of grassroots public security organs.
