| For a long time, how to handle a large number of civil disputes is a big problem in the construction of a harmonious society. As a social problem, the existence of dispute is inevitable.Especially, at present, our social economy is rapidly developing, the people’s legal consciousness is rapidly raising, our country is in an important period of social transition, the interests of all orders of our society are facing a major adjustment. In this process, our society accumulated various social disputes. These disputes naturally flowed to the police station to seek solutions.As an administrative organ, the public security department has responsibility to maintain a a harmonious society by legal mean, and they have resolved a large number of folk disputes by using of public security mediation in recent several years.But, at the same time, during the process of resolving social disputes, public security mediation also exposed many hidden troubles and problems:such as lack of legal regulation, coerced mediation, misused mediation, don’t mediate in order to complete the task targets, lack of professional mediator, lack of supervision system, and so on. These hidden troubles and problems are not conducive to resolve civil disputes in time, not conducive to eliminate social contradictions, or even may lead to more sharp contradictions, At last the government credibility will be cut down.Facing the high prominent contradictions among the people and highlighting criminal cases, the public security department and people’s policeman who have the responsibility to maintain the social order and keep the public security and stable will be taken to the teeth of the social contradictions storm.The social situation and law enforcement environment is very complex now. So how to scientifically and effectively regulate the behavior of public security mediation of the public security department and how to supervise the public security police’s responsibilities, to make the public security mediation really become the perfect mechanism and forming a normal insist on running it is an important subject in front of our c ommunist party and our government.Therefore, I think we should make the public security mediation system get close contact with all aspects of people’s mediation, judicial mediation, and other mediation in the chain. So that different functional localization mechanism will be more clearly, then we can unify the dispute settlement mechanisms, and construct the integrated mediation mechanism which conforms to the present situation in China.In this paper, the author Started from a grassroots police work perspective, combined with the public security law enforcement work practice, to research how to improve the work of public security mediation, and trying to make some suggestion about how to reform the public security mediation system and improve it.Some arrangements of chapters, sections and main content about this passage:the first part is theoretical summarize about the public security mediation system. In the second part, by analyzing the recent data, the author researched the development of the public security mediation system, the main problems that exposed through practice and the factors that affecting the development of the public security mediation system. In the third part, through analyzing some present states of public security mediate, the judicial mediation, and the people’s mediation, especially the control of foreign ADR practice, the author researched how to realize the integration of public security mediation to resolve disputes with the advantages of different system.In view of the above questions, based on the practice of basic public security work, the author make some suggestions and measures about put forward to further strengthen the reform of public security mediation work. |
