Study On The Procedural Regulation Of Regional Planning Discretion:An Empirical Study

With the change of the administrative interference to administrative direction, administrative planning with the future and the creation is more and more frequently used by the administrative organs. And in order to cater to the trend of economic regionalization, regional planning has emerged frequently such as national strategic planning and local planning. And the special characteristics of the regional planning make it have more extensive discretion space, so the concept of regional planning discretion has been formed. Nowadays the regulation of regional planning discretion is rarely effective in our country. Under these circumstances, the research on the regulation of regional planning discretion is of great theoretical and practical significance.The paper consists of four parts:In the first part it makes an empirical study on the development plan of Jiangsu coastal area and it briefly introduces the formation and implementation of the development plan of Jiangsu coastal area and analyzes the problems and causes of the planning process; Secondly, the general regulation mode of planning discretion is summarized and it discusses the necessity of planning discretion regulation and introduces three kinds of traditional regulation modes, such as legislation, administration and judicature; Thirdly it analyzes the limitations of the three regulatory models and the unique value of the procedural regulation; And the fourth part has been discussed the procedural regulation model of regional planning discretion and in this part it mainly introduces the basic principle and the main system of the procedure regulation, and puts forward the information disclosure system, the hearing system, the explanation reason system, the intergovernmental cooperation and supervision system and so on.
