The Research On The Legal Properties And Risk Control And Prevention Of Medical Assistance Service In Travel Insurance

With the tremendous growth of China tourism industry, the total population both for overseas and domestic travel is increasing enormously. Under these circumstances, the insurance coverage rate for travel insurance is also enhancing. Travel insurance not only covers risk and related claim for the insured, but also provides the insured with medical assistance service which is getting more and more attention. The medical assistance service is finally provided by professional assistance company and high cost will be occurred during the service process. Under current legal framework, there is no specific regulation and supervision about the legal properties of medical assistance service. This paper talks about the legal properties of medical assistance service through current relevant law regulation and then proposes some legal prevention and supervision solution. Under current legal framework, it has high importance and practical value to do this research.The first chapter gives a short briefing about travel insurance and medical assistance service. This paper summarizes travel insurance's category, feature, application of law and related legal issues. This paper also reviews medical assistance service's concept, content, value and operation model. This paper uses two real cases to do in-depth analysis of medical assistance service. This paper evaluates travel medical assistance-related country policy, law, and other legal regulation.The second chapter makes a comparison between different kinds of medical assistance operation model. Based on current travel insurance market trend, this paper brings out indemnity-covered model as most popular model. Under current legal framework, there is no regulation for the legal properties of indemnity-covered model. This paper discusses the legal properties from different two aspects within current legal framework. The paper proposes regulation and legal risk prevention solution and suggestion for the legal properties of indemnity-covered model.The third chapter evaluates and analyses the application of law of indemnity-authorized model, then put forward suitable operation model and application of law status review. This paper proposes suggestion regarding indemnity-authorized model realization and legal environment based on the successful experience of car insurance information platform. The paper reviews the feasibility of travel insurance big data platform then proposes the feasible solution.Finally, we summarize the whole paper in the conclusion part.
