Research On The Legal System Of Medical Assistance In China

Since the reform and opening up,China has made a lot of achievements along the road of socialism with Chinese characteristics,and the economic development has been stable and getting better.The polarization between the rich and the poor is obvious,the poor people look down on diseases and cannot afford to buy medicine,the life and health of the vulnerable groups has become a problem that cannot be ignored,and the medical assistance system has been born,which has become a supporting system to ensure the poor people's health and survival.In the past five years,China has built the world's largest medical insurance network,and medical assistance has also focused on the treatment of serious diseases to avoid poverty caused by serious diseases.But for poor families,the elderly still dare not go to the hospital to see a doctor and choose to give up treatment because they are guaranteed medical care and enjoy medical assistance.This phenomenon means that there are still considerable problems in China's medical assistance system.By deeply studying the legal system of medical assistance in China and combining with the academic research on this issue,this paper summarizes the problems existing in the legal system of medical assistance in China,and then makes a comparative analysis of the relevant systems in foreign countries and other regions.The first chapter of this paper expounds the basic theories of medical assistance,including the concept definition and legal characteristics of medical assistance,and explores the theoretical basis of medical assistance.The second chapter mainly combs the evolution of China's legal system of medical treatment,and to our country present legal system of medical treatment after a brief introduction of the content,summarizes the existing problems in medical law in China,from legislation,financing mechanisms,rescue standards and interface with the rest of the social security system and so on several aspects are analyzed.Chapter three focuses on studying the legal system of medical assistance in foreign countries and other regions,and summarizes its experience.The fourth chapter puts forward some Suggestions to improve the legal system of medical assistance.
