In the development period of E-commerce Business Method, there were three protect models which was Copyright, Commercial Secret and Patent, the author contrast these three protect models, the Patent Model can not only protect the nuclear value----original idea at first, it can also avoid the difficult on showing evidence, so, the Patent Model is the most reasonable protect model.However, E-commerce Business Method is not protected by Patent in China, the only way to gain the protective cover is to switch to the computer programma which is highly technical, it’s not fit the society which has high-speed growth in information technology and electronic tool. So, if we want to construct the Electronic commerce system, it’s necessary to make sure the E-commerce Business Method can be the object of Patent, clarify the meaning of “rule or method for performing a mental act”and the definition of the technical rule, and the standard of censorship must be further clarified, it’s very important for the healthy development of our E-commerce Business Method.
