The Research Of Telecom Industry Procurement Legal Risk

Because of the saturated traditional telecom business market and the sharp reduced traditional business, the telecom enterprises are more caring of the cost control. Good purchasing management become the important way for cost control. In this paper, the author will research the telecom industry procurement legal risk, including the content of the legal risks, the suggestion of the risk prevention and control, the principles of risk management and opportunities and challenges.Based on the empirical analysis method, combined with The Tender Law, The Government Procurement Law, The Contract Law, and The Telecommunications Regulations, the author analyses the procurement legal risk and give the telecom enterprises some suggestions to prevention and control.This paper is divided into four parts:The first part is to introduce the legal risk's development in the word. Risk management originated in the United States, marked by SOX, prompted the countries all over the world to establish the risk control system.The second part is to analyse the main procurement legal risk in the Chinese telecom industry, and give the suggestion to control the risk. The procurement legal risk include the choice of suppliers risk, the contract risk. The telecom enterprises should abide by the laws, strengthen the management system to avoid the legal risks.The third part is to analyse the principle and strategy of risk management. The legal risks should be prevent, control and remedy in the whole process in the procurement activities.The fourth part is to analyse the legal risk management development bottleneck, and the future outlook. The development of the legal risks, met with management functions, management, value orientation, resource management, and other aspects. The development trend of legal risk management is to establish a long-term mechanism.
