On The Law Guarantee Of Good Governance

Good Governance is, in fact, the return of the state power to the society, as well as a process of power to the people,and a more inclusive and participatory concept.It is not a set of effective rules and regulations, nor an efficient activity, but a process which is full of justice.A broad participation in state governance, with a responsible and reliable government, transparent state institutions as well as respect for human rights and security constitute the core connotation of good governance. Although good governance does not mean a formal system, it needs constant interaction. Thus, the good governance requires a set of complete and effective operation of the system as a support, and the rule of law is the best choice. Based on this, the relationship between the rule of law and good governance has been stretched out.The world bank firstly used the word ‘crisis of governance' to generalize the situation in Africa. Then the western political and economists endowed the governance with a new connotation. Thus, the first part of the article firstly analyzed the theory origin of good governance, describing respectively the background of good governance both in Africa and the west. According to the definition of good governance given by the world bank, OECD, the African union organizations and scholars in the field of the current governance, the article argued that, participation, responsibility, transparency and human rights are the core elements of good governance's connotation. In the second part the article discussed the relationship between good governance and the rule of law. Good governance is the goal of the rule of law, and the rule of law is an important means of the realization of good governance. Besides, good governance leads the rule of law to good law in the aspect of value, and injects the order value, human rights value, justice value as well as efficiency value to the rule of law.The third part further demonstrated that the rule of law is the inevitable choice of good governance. The rule of law runs through each process of good governance. It not only conforms to the political legitimacy and diversified needs of good governance, but also is the logical choice of good governance.At last the article mainly analyzed how the rule of law system guarantee for good governance.The core of the rule of law is to guarantee the rights and limit the power, protecting the participation, responsibility, human rights and transparent connotation by the constructing the legal system, securing the whole process of good governance.
