Study On Several Legal Issues Of Liberalization Of Trade In Service Among Guangdong, Hong Kong And Macao

Achieving the liberalization of trade in service among Guangdong, Hong Kong and Macao is the inevitable result of in-depth economy cooperation among Guangdong, Hong Kong and Macao, and also the staged achievement of basically achieving liberalization of trade in service among Mainland, Hong Kong and Macao. The Agreement between the Mainland and Hong Kong/Macao on Achieving Basic Liberalization of Trade in Services in Guangdong of CEPA and the Agreement on Trade in Services of CEPA have signed, these two agreements provided the institutional guarantee of achieving overall liberalization of trade in service among Guangdong, Hong Kong and Macao. In this paper, the first chapter on the basic of discussing the significance of achievement the liberalization of trade in service among Guangdong, Hong Kong and Macao, through analyzing the main content and main features of these two agreements, and combining with the reality problems of trade in service among Guangdong, Hong Kong and Macao, sums up the main legal issues of achieving the liberalization of trade in service among Guangdong, Hong Kong and Macao. The second chapter, through comparing the advantages and disadvantages of two kind of management mode of admission of foreign investment of trade in service, and using the successful experience of "negative list" management mode of the current regional trade agreements for reference, provides some suggestions for improving admission of foreign investment of trade in service among Guangdong, Hong Kong and Macao. The third chapter, on the basic of discussing the related rules of the national treatment of trade in services, through analyzing the national treatment clauses in two agreements and connecting with the current problems of trade in service among Guangdong, Hong Kong and Macao, suggests some concrete measures of implementing the national treatment of trade in service among Guangdong,Hong Kong and Macao. The fourth chapter, through stating the necessity of improving the emergency safeguard measures of trade in service among Guangdong, Hong Kong and Macao, on the basic of using the experience of the emergency safeguard measures of the regional trade agreements for reference, provides some suggestions for improving the emergency safeguard measures of trade in service among Guangdong, Hong Kong and Macao.
