A Research On The Legalization Of The Network Information Regulation In China

The online world is full of different kinds of information based on the Internet,and the information is received by people through text, voice, images, video and other forms, which is commonly known as "network information". In most part of the world, although the content, means, strength and other aspects of the regulation are different, the vast majority of countries which have been incorporated into the international Internet, have carried out the supervision and management of the network information. Since 1994, when it was brought into the big family of Internet, China has begun to explore and practice the supervision of network information under the law. Through more than 20 years of development, China's network information supervision legal system has been initially set up and the network information management mode which was dominated by the central government,has been formed. The achievements were significant. But in recent years, along with the network popularization and appearance of new network application,the level of supervision of Chinese network information is obviously lagging behind. All kinds of problems come out because of our shortage in supervising it. Internet pornography information ? violent and horrible information, fraud information are numerous and citizens' personal network information has been stolen and sold illegally. These are not only serious threats to personal rights and property rights of Internet users, but also seriously interfere with the stability of the country and society. According to a survey by the China Internet Network Information Center (CNNIC), network information satisfaction of Chinese Internet users was not high with the "general" and "not satisfied" attitudes accounting for 72.5%. The rapid development of network does not lead to improvements in Internet users' satisfaction. It is really astounding. On the one hand, it is due to relevant legal norms cannot meet the needs of development, on the other hand is due to the rigidity and backward of supervision.At present, status of these legal norms is low,and the content is relatively scattered. In academia, the definition of Network information is not clear.The scope of regulation and regulatory standards are not clear too. So discusses on how to further promote the network information regulation under the rule of law is very necessary.It needs to be set reasonably from the perspectives of legislation, law enforcement, law-abiding.This paper is divided into three big parts. The first part mainly introduces the concepts of the network information, network information supervision,, network information supervision under the rule of law, and the significance of Chinese network information regulation under the rule of law. The second part describes the general status of Chinese network information legalization, including the history of network information regulation under the rule of law, current achievements and presences. The last part introduces how to improve the Chinese network information supervision under the rule of law.The author believes that under the joint efforts of legislative agencies, administrative regulatory agencies,Internet users and Internet enterprises,Chinese network information environment will be more clear and the network information regulation under the rule of law will be more perfect.
