Research On Legal Issues Of Network Security Supervision

Today’s world is a world of rapid development of network technology.Internet has entered people’s daily life and become an indispensable part of people’s work and daily life.Internet security,risk and other issues will promote the supervision of network security to the attention of the international community.Experts and scholars at home and abroad have studied the network security supervision in many fields,such as politics,economy and so on.They have made a thorough and meticulous study on the system,mechanism,responsibility and dilemma of the network security supervision.However,most of them are studies in a specific field,and no comprehensive studies have been carried out.Network security supervision is a form of supervision and management of network security implemented by the government on behalf of the state.The development of computer network provides practical help for network security supervision.At the same time,there are many problems such as information leakage,hacker attacks and so on.China formally implemented the "Network Security Law" in 2017,as the basic law of network security supervision,the status of this Law in the field of network security is self-evident.This law regulates network operation and network information,clarifies the attitude of the state to support network development,determines the main body of government network supervision,provides the legal basis for network security supervision,and points out the direction of supervision.At the same time,the principle of co-governance implied in the law,that is,the principle of government,enterprises,individuals and other relevant parties jointly participating in network supervision,is consistent with the network supervision system expressed in this article.Our country’s network supervision is not perfect enough.Although the basic law of supervision has been promulgated,we still need to draw lessons from the strengths of other countries’ regulatory system and strive to build a regulatory system with Chinese characteristics.This paper studies and analyses the network security supervision of our country from three perspectives of country,industry and individual.This perspective is the research idea of the whole paper and runs through the whole paper.In the introduction of the paper describes the reasearch background and significance of the paper,and the research theories of scholars at home and abroad are comprehensively narrated.The comparative analysis method and literature analysis method used in the research are expounded,and the innovation of the paper is put forward.The first chapter of this paper is an overview of network security supervision.It explains the definition of network security from the legal and government documents,and gives a new connotation of network security from this paper.In addition,this paper also expounds the network security problems faced by our country’s state,industry and individuals,puts forward the necessity of network security supervision for citizens,social order and national overall security,and illustrates the urgent need of the current society for network supervision.The second chapter is about the current situation and problems of network security supervision in China.This chapter mainly elaborates the current situation of network security supervision in China from two aspects: the legislation of network security and the construction of network security supervision system.In addition,it explains the deficiencies of network security supervision in China from three aspects: country,industry and individual.Chapter three elaborates the content of the oversea network security supervision system,analyses the oversea network security supervision system,from the national supervision system,policy to the industry supervision and personal information protection,and provides useful experience for the development of our network security supervision,and puts forward some suggestions for China’s regulatory system.The fourth chapter is the way to improve the supervision of network security in China.This chapter combines the oversea supervision experience and the existing supervision problems in China,and puts forward some suggestions to solve the problems of network security supervision in China from three aspects: promoting the construction of national network security supervision system,strengthening the supervision of industry organizations and strengthening the protection of personal information security.Promoting the construction of the national network security supervision system mainly includes adjusting the government’s supervision system and perfecting the legislation of network securitysupervision;strengthening the supervision of industry organizations includes clarifying the main clarifyingthe main body of industry supervision,speeding up the formulation of internal supervision rules and strengthening the construction of industry ethics;strengthening the protection of personal information security includes three aspects: formulating a special law on personal information protection,improving the right relief system,and improving the awareness of personal information protection of netizens.
