A Study On The Legislation Of Administrative Assistance Among Administrative Subjects

Administractive Assistance (hereinafter as "AA") among administractive subjects (hereinafter "ASs") plays an important role in enhancing the promotion of administrative efficiency, which may also help to achieve the goals of administrative management and protect the legitimate interest of administrative counterpart. However, owing to the legislation shortage of AA, the assistance among ASs has been implemented as an administrative routine as is depicted in the administration arena, which, therefore, makes AA informal and optional. AA among ASs has not been laid enough emphasis on despite the fact that some regional procedural rules concerning with AA have been passed in recent years. As a result, the implementation of AA is not so well as expected. This thesis is based on such a condition, analyzing the status quo in legislation of AA and trying to find some relevant solutions.In this thesis, the first part is about some basic theory such as concept, characteristic and classification of AA among ASs. In the second part, problems of AA are analyzed upon theelaboration of the current legislation of AA among ASs, as well as aspects like the subjects of assistance, application of assistance, procedure and fare of the assistance, liability and some relevant measures. The third part is about the comparative study of AA in Germany, Korea and Taiwan upon which some suggestions are put up accordingly. In the last part, some suggestions for the improvement of AA in China is given from seven aspects, i.e., reasonable specification of the subjects in AA, clear application criteria for AA, explicit ways for AA and so on. Meanwhile, some suggestions on how to improve the legislation of AA among ASs are also given as a conclusion of the whole thesis.
