The Applied Research About Deng Xiaoping's Oncept Of Ruling By Law Using In Public Security Work

Deng Xiaoping's thoughts on nomocracy is an important component of Deng Xiaoping Theory and a milestone in the history of the nomocracy thoughts in Marxist Ideology.It is also the theoretical basis and guiding principle in building socialist nomocracy country.The core and essence of Deng Xiaoping's thoughts on nomocracy is to construct a socialist nomocracy country with prioritized democracy and comprehensive legal system,and further speaking,that is to govern the country according to law.The principle proposed by Deng Xiaoping---“there must be laws to go by,the laws must be observed and strictly enforced,and that law-breakers must be prosecuted”,includes many requests in the fields of legislation,law-abiding,law enforcement and justice,as well as legal supervision.The Public Security Work is a specialized work focusing on national security,public security order and social order.It is a vital component of the political work of people's democratic dictatorship.With the rapid development of all aspects in our society,as the instrument of people's democratic dictatorship,the Public Security Organs are undertaking more and more social responsibilities.The requirement from people to the Public Security Organs on implementing the law in a just,fair,honest,efficient and civilized way is increasing.The Public Security Organs is playing a more and more important role on securing and serving the economic development.Facing with opportunities and challenges,how to use Deng Xiaoping's Legal Thoughts as a powerful weapon to arm thoughts and guide practice,as well as promoting the development of Public Security Work in such a new period is becoming particularly important to the Public Security Organs and its subject of law enforcement---the people's police.Focusing on this issue,this thesis is researching how to enhance and develop Public Security Work in the aspects of strengthening consciousness,perfecting laws and regime,etc.by using Deng Xiaoping's Legal Thoughts.Combined with the current challenging situation that the Public Security Work is facing to,this thesis discusses the practical significance of using Deng Xiaoping's thoughts on nomocracy to guide the Public Security Work through multiple approaches such as strengthening the standardized construction of law enforcement,performing legal duties effectively,maintaining social and political stability,protecting the interests of the people,serving economic and social development,protecting social equity and justice,etc.This thesis is focusing on the relationship between law enforcement of public security and civil rights in terms of rule of law.It generalizes the essence of the unification between law enforcement of public security and civil rights based on theories that public power stems from,protect and obey civil rights.It also summarizes the representation of the opposition between these two aspects by explaining the contradiction between public interest and individual interest,order values and individual value,executive authority and passive aggressive behavior.This thesis proposes the strategies about how to balance the public enforcement power and civic rights in building the nomocracy country.This thesis mainly consists of three parts:The first part focuses on researching and studying the origin,development and content of Deng Xiaoping's thoughts on nomocracy.It analyzes the objective conditions of the formation of Deng Xiaoping's thoughts on nomocracy from the aspects of theoretical foundation,historical background and social condition.It also explores the four core concepts: to strengthen the construction of legal system,to govern the country according to law,to emphasize the supreme legal authority of the Constitution,to insist that all people are equal before the law and to highlight the purpose to educate the public.The second part analyzes the challenges that the Public Security Work are now facing to.Thus we could demonstrate the necessity and the practical significance of using Deng Xiaoping's thoughts on nomocracy to guide Public Security Work.It shows the complex situation of the Public Security Work by illustrating the factors which are social stability,interpersonal conflicts,social interests and hostile forces.The conclusion is that Deng Xiaoping's theories are the fundamental method to solve the problems mentioned above.The third part researches the application of Deng Xiaoping's thoughts on nomocracy in Public Security Work in three aspects: First,we need to carry out the concept of serving people,to emphasize the importance of protecting human rights and to implement the social responsibility of Public Security Organ and the People's Police.Second,we need to regulate the discretion of law enforcement of Public Security Organ,to control public power of supervision and to promote the legitimacy and credibility of law enforcement.Third,we need to implement Deng Xiaoping's thoughts on nomocracy to guarantee the law enforcement activities and legitimate rights and interests of the People's Police.Thus we could try to find practical solutions and methods corresponding to the reality of the Public Security Work.
