Research On School Sports Legislation In China

School physical education is an important part of the education cause and the main part of teenagers sports in our country.Its developmental level directly affects the physique development of teenagers and the overall development of the sports undertakings in our country.The development of school physical education also plays an important role in cultivating high-quality talent with all-round development in morality,intelligence and physique.Under the social background of building a well-off society comprehensively,deepening the reform comprehensively and governing the country comprehensively based on law,the developmental level of school physical education affects the construction of a well-off society.The reform of school physical education should be a part of the comprehensive and deepening reform of our sports and education enterprise.Its development must also be incorporated into the orbit of the law.Only according to the requirement of era development,and constantly improving the school sports legislation,can we continuously propel and realize the healthy and rapid development of our sports and education enterprise on the orbit of the rule of law.For this reason,the author hope that this study can find the shortcomings of existing research results on the basis of combing through existing research results on school physical education rule of law.From the perspective of school physical education legislation in our country,combining with school sports law enforcement and administration of justice,this article aims at further advancing school physical education in our country,hoping to find problems existing in the school sports legislation in China,putting forward corresponding countermeasure and the suggestion,and providing reference for appropriate body to perfect school sports legislation in our country.At present our country has basically formed school sports legal system,taking “the sports law of People's Republic of China” as the leading and basic law,“the school sports work regulations” as branches,taking “the national fitness ordinance”,relevant local regulations as well as various legal documents of ministries and commissions as auxiliary and supplement.But there are still many problems in our school sports legislation.From the statistical analysis on Chinese school sports legislation,we could find that our school sports legislation has many problems,such as our current legislation was enacted too early,relatively insufficient in quantity,has low effectiveness hierarchy,relatively rough in content and so on.Based on this,after analyzing the demands of the time on our country's economy,society and the rule of law,education,sports development,etc,the author proposed basic strategies on consummates our school sports legislation: to promote the overall level of the rule of law in China,to promote the elevation of the concept of the rule of law and the general application of the rule of law thinking,to strengthen the school sports legislation,law enforcement,judicial research,to strengthen the repeal,reform and establish work of school sports legislation,to deal with the relationship between specialized legislation on school sports and relevant legislation,to pay attention to promote the law enforcement,judicial and legislative supervision in school sports field.On the basis of combing through the current school sports legislation in China,this paper discusses the characteristics of the current Chinese school sports legislation in detail,and analyzes present situation and existing shortcomings of current school sports legislation.Combining the development of our country's economy,society and the rule of law,education and sports and other social aspects,the author reflects on the requirements of era development on further perfecting school sports legislation in our country.Though,the author mainly makes research and discussion on school sports legislation from the macroscopic perspective,this article has certain theoretical significance on further research and perfection of our country school sports legislation,for special research achievement on school sports legislation in China is not very rich.Under the premise of macro layout,only the rule of law is put into practice in every field,can the real comprehensive rule of law be formed in our country.As a specific field of society,the formation of its school sports legislation is a specific part of the rule of law in our country.The author sincerely expects that the school sports legislation become more complete,and our school sports work and education undertakings develop better and faster.
