| Under the situation of economic and political globalization irreversible,corruption is no longer a local problem,but a influence multinational of all social and economic phenomenon.Many countries have realized that only fully and comprehensive international cooperation can we effectively control and punish corruption,anti-corruption international exchanges and cooperation with more and more widely.In China's case,with China's efforts in fighting corruption crime,corrupt officials fleeing outflows and corruption problems become the new characteristics of corruption crime in our country,to crack down on such crimes have become a new focus of China's anti-corruption work.To effectively combat fled overseas,we must strengthen international cooperation.This paper mainly on the current situation of the present stage of international cooperation against corruption and the corresponding perfect research cooperation mechanism,so as to establish conforms to the present Chinese political,economic and cultural characteristics of the mechanism of international cooperation against corruption.This article is divided into four chapters,arranged as following:first,the first chapter is an overview of international cooperation against corruption.Countries in political,economic and cultural exchanges increasingly close,such as the anti-corruption as the world's countries facing the common task.For the deep meaning of corruption and anti-corruption,and the way of international cooperation against corruption explains,summarized the domestic and foreign research achievements for the international anti-corruption,feasibility research ideas to learn theory,combined with China's ongoing "fox hunting action" comparative analysis the advantages and disadvantages in China in the international cooperation against corruption.Put forward in the international anti-corruption cooperation better play to the role of financial institutions research train of thought.The second chapter analyses the current situation of the international cooperation against corruption in China.This chapter content combined with specific case on the use of extradition in our country,repatriation,prosecution,QuanFan anti-corruption cooperation mechanism is explained.With corruption crime internationalization in our country has accelerated the pace of international cooperation,our country in recent years and many countries signed on extradition,judicial assistance treaty,domestic law also gradually improve for our country to carry out the corresponding legal basis was provided for the international cooperation against corruption.Pointed out that in the international cooperation of anti-corruption in China headquarters,judicial construction,there are problems,such as cooperation ability need to reload better participate in global governance of corruption.The third chapter analyzes the problems in international cooperation against corruption.From the perspective of the "fox hunting action" in the specific case in criminal judicial assistance in China,the criminal suspect and extradition,practical experience,legal system,the problems existing in the aspects such as asset recovery,analyses the legal obstacles that exist in a substantive law and procedural law.In the paper also expounds the definition of asset recovery and basic procedure,confirm the assets in the asset recovery process is studied,frozen assets,confiscated assets.The fourth chapter according to the questions suggest promote anti-corruption cooperation effect in our country.These Suggestions both macroscopic aspects including promoting the construction of legal system,strengthen diplomatic exchanges between countries establishing the image of our country,expand areas of cooperation and international investigation have suggested that micro-for example,sorting out documents,naked official property declaration,management,etc.The world bank group for the investment Banks put forward sound money,and some improvement ways of control and improve the system of anti-money laundering,puts forward how to strengthen the prevention in the asset recovery,several measures to satisfy the needs of the international cooperation. |
