The law of legislation which was revised in 2015 expanded the principal part of legislation of district and conferred the Power Of legislation to the Prefecture-level City,which was the milestone in the history of legislation of China.Thepower of legislation of the Prefecture-level City belongs to the scope of the power of legislation of the district.The power of legislation of the district has gone through three development stage which was dispersion of legislation in district,concentration of legislation in the central government and relative dispersion of legislation in district since the new government of China established.In general,the power of legislation of the district present the tendency of enlarging,from the bigger city to the Prefecture-level City,the principal part of the power of legislation is enlarging constantly..Conferring the power of legislation to the Prefecture-level City is the inexorable trend of the development of economy.furthermore,it also work on norm of system of legislation and the enthusiasm of the legislation of the district and the autonomy of district.In further,it also makes sense on the construction of democracy and governed by law,the construction of capacity and system of governance of district,the advance of rule of law.However,we have the legislation experience of the bigger city,the power of legislation of Prefecture-level City still face some dilemma in the theory and practice,which we can't ignore.In theory,we need to definite the status of the power of legislation of the Prefecture-level City in the constitution.We also need to definite the jurisdiction of the power of legislation of the Prefecture-level City,because the law of legislation which was revised in 2015 is wide in regard to the jurisdiction.In practice,the power of legislation of district refers to benefit in different aspect and we need to balance the interest of district.What's more,the status of the People's Congress of district is weak in the legislation of district and the people lack participation about the legislation of district,we need to extrude the status of the People's Congress of district on the power of legislation and encourage people participate in the legislation of district actively.This article try to probe into the dilemma of the power of legislation of Prefecture-level City and put forward to resolution,in order to obtain enlightenment to the perfection of the power of legislation of Prefecture-level City.
